RICHMOND, Va. (CN) The Fourth Circuit on Monday revived an election watchdog’s challenge seeking documents in North Carolina that relate to the citizenship status of registered voters.
“Upon our review, we hold that the district court erred in dismissing the complaint at this stage of the proceedings. Because discovery was not conducted, we cannot discern on this record whether the foundation may be entitled to disclosure of some of the documents requested,” U.S. Circuit Judge Barbara Keenan wrote in a 22-page opinion issued Monday.
The Public Interest Legal Foundation sued the North Carolina State Board of Elections in 2019, alleging a violation of the disclosure provision in the National Voter Registration Act of 1993 (NVRA).

RICHMOND, Va. (CN) Attorneys sparred before a Fourth Circuit panel on Tuesday over the constitutionality of a policy implemented by four federal agencies, which requires former intelligence agency employees and military personnel to obtain the government’s permission before publishing works that relate to their service.
Five former federal employees brought their challenge to the government’s “prepublication review” system in 2019, claiming the policy violated their rights under the First and Fifth Amendment.
Attorneys for the Knight First Amendment Institute and the American Civil Liberties Union who filed a lawsuit in federal court in Maryland on behalf of the public servants say the policy’s submission requirements and review standards are too vague, confusing and overbroad.

RICHMOND, Va. (CN) Arguing a CBS interview inflated and endorsed two women’s claims that Virginia Lieutenant Governor Justin Fairfax sexually assaulted them, his lawyer told an appeals panel Thursday the official’s libel suit was wrongly tossed out.
“CBS did not just report the false allegations of rape and sexual assault against Justin Fairfax. It heavily promoted direct interviews resurrecting false allegations, two months after they were made,” Fairfax’s attorney Tillman Breckenridge said before the Fourth Circuit at a remote hearing Thursday.
