MO Supreme Court rules on public records, appoints Drury grad as chief

View Comments The Missouri Supreme Court ruled on three cases this week, including one against the governor s office regarding open records and a reversal of a Greene County Circuit Court decision.  The state s highest court will also have a new chief justice starting Thursday in Judge Paul C. Wilson, a graduate of Springfield s Drury University and Jefferson City native. Wilson will serve as chief justice until June 30, 2023. In a unanimous decision, the court ruled that state agencies could not charge lawyers fees for time they spend reviewing public records that are requested under the Sunshine Law. The decision, a reversal of a lower court ruling, is a victory for advocates of transparency and public records access.

Missouri High Court Says State Can t Charge Attorney Fees for Sunshine Law Records Requests – Courthouse News Service

(Image by Ag Ku from Pixabay via Courthouse News) JEFFERSON CITY, Mo. (CN) Government entities cannot charge for time attorneys spend redacting documents requested under the Sunshine Law, the Missouri Supreme Court ruled on Tuesday. In a 6-0 decision, the high court found that Missouri’s Sunshine Law allows government entities to charge public records requesters for research and staff time, but that attorney review time doesn’t qualify as either. “Attorney review time has no relation to providing ‘access to public records maintained on computer facilities, recording tapes or disks, videotapes or films, pictures, maps, slides, graphics, illustrations or similar audio or visual items’ or making ‘paper copies larger than nine by fourteen inches,’” Judge Patricia Breckenridge wrote in the 27-page opinion.
