On May 12, 2021, New Jersey Governor Phil Murphy signed into law a bill requiring insurers to go on record as to whether their policies, which provide coverage for the loss of use and occupancy and business interruption, cover global virus transmission or pandemics. The law first requires an insurer to disclose to new and renewing insureds whether the policy provides such coverage. The Commissioner of Banking and Insurance prescribes the form and manner of providing this notice for this first provision. The law also requires any insurer who has in force such a policy to so inform its insured in writing (via mail or electronic means) within 30 days of the date of enactment.

CHARLESTON A Kanawha County couple is suing the City of South Charleston for damages sustained to their home after sewage infiltrated their home.
Timothy Cerullo and Courtney Cerullo filed the lawsuit against South Charleston and Nationwide Mutual Fire Insurance Company alleging sewage backed up into their home on April 25, 2019, emerging through various drain portals and walls and spreading throughout their house, making the house uninhabitable, according to a complaint filed in Kanawha Circuit Court.

MEDIA – A fatal motor vehicle collision and subsequent lawsuit in a Delaware County court has had a settlement in the action approved at a final amount of $200,000.
Daniel M. Shaffer (Executor of the Estate of Margery A. Shaffer) of Swarthmore initially filed a petition in the Delaware County Court of Common Pleas on Feb. 3 versus Patrick J. Barron and United Services Automobile Association (doing business as “USAA”) of San Antonio, Texas.
“The Petitioner believes and therefore avers that the decedent Margery A. Shaffer died on July 26, 2019 at approximately 12:57 a.m. as a result of the pedestrian/vehicle accident, without lengthy conscious pain and suffering, which is consistent with the Medical Examiner’s records,” the petition stated.
