Despite a broader societal awakening, most sexual assaults are still not reported. Among those substantiated by police, historically, about one in 10 leads to a conviction. If these grim odds weigh on a survivor’s decision to come forward, the rare verdicts are a beacon of hope.
That hope can be extinguished, however, when a conviction is overturned on appeal. In a recent decision, the Supreme Court of Canada expressed frustration some appeals are based on excessive scrutiny of the trial judge’s written reasons for judgment.
