Supreme Court (SC) Associate Justice Edgardo L. Delos Santos is set to retire on Wednesday, June 30, a year earlier than his mandatory retirement at age 70 on June 12, 2022.
The SC, as a full court, had approved Delos Santos’ early retirement “for reasons pertaining to his current state of health.” His “state of health” was not disclosed.
With the retirement of Delos Santos, who was appointed by President Duterte in Dec. 2019, there are now two vacancies in the 15-member SC.
The first vacancy was a result of the promotion of then Associate Justice Alexander G. Gesmundo as Chief Justice last April 5.

+ May 28, 2021 THE Court of Appeal (CA)’s Cebu station has upheld its earlier decision exonerating former Daanbantayan mayor Augusto Corro from administrative charges relating to the distribution of assistance to Typhoon Yolanda victims in 2014.
In a six-page decision issued on April 12, 2021, the CA-Cebu Station’s Special Former Eighteenth Division denied the motion for reconsideration (MR) filed by former Daanbantayan councilor Renato Benatiro asking the appellate court to reverse its Oct. 30, 2019 decision.
CA Cebu Associate Justice Marilyn Lagura-Yap said Benatiro’s MR was denied for lack of merit. She said Benatiro also failed to provide new evidence to support his motion.

Published May 4, 2021 7:15pm State lawyers on Tuesday defended before the Supreme Court (SC) the power of the government to implement warrantless arrests of persons suspected of committing acts of terrorism. At the resumption of oral arguments on the petitions seeking to nullify the anti-terror law, Assistant Solicitor General Marissa dela Cruz-Galandines said terrorism must be “nipped in the bud” through warrantless arrests. “There are instances when the law enforcement agents or the military personnel would not have the luxury of time to go to court and ask for a warrant of arrest. We are dealing with terrorism, Your Honor. Time is of the essence,” she said when asked by SC Associate Justice Edgardo delos Santos whether law enforcers should obtain an arrest warrant from the court.

The Judicial and Bar Council (JBC) has opened the application or recommendation to the Supreme Court (SC) associate justice post that was vacated with the promotion of Associate Justice Alexander G. Gesmundo as Chief Justice and head of the judiciary last April 5.
In an announcement, the JBC said applications or recommendations must be received not later than May 10.
It said applicants and those recommended must submit the complete and accurate digitized version of all documentary requirements to [email protected].
The JBC is the constitutional body that accepts, screens, and nominates appointments to the judiciary.
There may be another vacancy in the 15-member SC if the High Court approves the retirement sought by Associate Justice Edgardo L. Delos Santos who had signified his intention to retire early on health reasons.
