The measure, HB1280, is designed to mitigate jail overcrowding and help prevent people who are arrested for minor offenses from languishing in county jails longer than necessary.
âHolding an individual behind bars for days before a bond hearing or for hours and hours after bail has been posted is not justice,â said Rep. Serena Gonzalez-Gutierrez, D-Denver, one of the billâs sponsors.
It also helps address a possible problem in the 21st Judicial District, which encompasses Mesa County, from having people held in jail for days or weeks just because they were arrested under a warrant issued in another county and canât be transported to another jurisdiction right away.

The Mesa County Sheriff s Office and Chief Judge Brian Flynn are named in an ACLU lawsuit on Tuesday, April 27, 2021, by a woman who claims she was wrongly held for 15 days, in violation of her constitutional rights, over a warrant from Boulder County. In Boulder she was released on her personal recognizance before the charge was soon dropped.
The American Civil Liberties Union filed a lawsuit against two Mesa County officials Tuesday, saying they both caused a Boulder woman to be jailed for two weeks for no good reason.
The lawsuit, which was filed in federal court, names Chief Judge Brian Flynn of the 21st Judicial District, which encompasses the county, Mesa County Sheriff Matt Lewis and Boulder County Sheriff Joe Pelle.
In it, ACLU attorneys alleged that Flynn illegally barred judges in his district from setting a bond or allowing Boulder resident Michelle Reynolds to be released on bond or obtain pretrial release, causing her to spend 15 days in jail unnecessarily.
