FWC orders employee reinstatement after heat-of-the-moment remark

Fair Work Commissioner Iain Ross. Source: AAP/Alan Porritt In the unfair dismissal jurisdiction, the primary remedy is reinstatement. This means the employer is ordered to return the employee to their employment in the position they held immediately prior to their dismissal or another position on no less favourable terms. The Fair Work Commission (FWC) will have regard to a number of circumstances when considering whether to reinstate an employee, such as whether there has been a loss of trust and confidence in the employment relationship which would make reinstatement inappropriate.     In a recent decision, the FWC was tasked with determining whether a breakdown of trust and confidence in the employment relationship was sufficient to conclude that the reinstatement of the employee was impractical.

Flaws Found in an Australian Electronic Voting Software

Flaws Found in Australian Electronic Voting Software Four cyber and electoral system researchers have identified three flaws around the use of electronic voting at the 2020 election for the Australian Capital Territory (ACT) government. The researchers said the issues did not affect the outcome of the most recent election but warned that the flaws could be exploited in future to sway voting patterns. “We are not claiming that corruption occurred, nor that the system was designed with that goal in mind. There certainly were errors undetected by Elections ACT; however,” they said in a submission (pdf) to the ongoing Inquiry into the 2020 ACT Election and the Electoral Act.

Small Australian Mining Firms Being Squeezed Out by Climate-Change Activism

Small Australian Mining Firms Being Squeezed Out by Climate-Change Activism Local Australian resource firms say financial institutions driven by climate change are constricting the industry by withholding vital insurance and loan services crucial for new mining projects. Leading some companies to warn that global mining conglomerates who can go offshore for financial support will become more entrenched as smaller businesses risk closing. This comes as a parliamentary inquiry examines the impact the financial sector is having on Australian exports. Chair of the Joint Standing Committee on Trade and Investment, George Christensen, said mineral exports generated billions in revenue for the country, and any impact on the industry needed to be scrutinised.

Corruption threat from surge in consultants, hollowing out of public service

Corruption threat from surge in consultants, hollowing out of public service Outsourcing of policy advice doesn t merely undermine the Australian Public Service, a top public policy expert argues, it increases the risk of corruption. Glyn Davis (Image: AAP/Alan Porritt) One of Australia s foremost public policy experts has strongly criticised the dramatic expansion in outsourcing of policy advice by the federal government, warning that it risks corruption and has created a vicious circle of declining public sector expertise. Glyn Davis, a former senior public servant at the state and federal levels, former University of Melbourne Vice-Chancellor and a prominent public policy academic, on Friday delivered the annual Jim Carlton Integrity Lecture at the University of Melbourne.
