The motion to dismiss also said that the state has not provided testimony or physical evidence against Russ.
The motion further said that there was no evidence in the 10,000 pages of discovery or in audio and video recordings provided by the state that Russ, then 16, knew the shooting was to take place, that she fired a weapon then or any other time or took part in the crime.
The motion also cited Russ s lack of criminal record, that she has completed high school and was working in the health care industry when she was arrested.
Court documents show the five, arrested Dec. 8, 2020, communicated their intentions for hours before the mayhem that also left at least 14 others wounded, one seriously, at the Evans Avenue Club.
Drive-by shooting in Fort Myers sends 1 to hospital

A woman was taken to Lee Memorial Hospital after a drive-by shooting in Fort Myers on Tuesday.
The shooting happened near the Jones Walker apartments on Blount Street. Fort Myers police said the victim was in stable condition.
The shooting took place at around 11:30 a.m. and caused a lockdown at nearby Royal Palm Exceptional School.
Neighbors said they heard around six to seven shots.
Jones Walker apartments have seen their share of violent crime in the past but have since undergone a makeover.
PIE students make blessing bags to help those in need

Principal Tom Millins of Pine Island Elementary School said “what makes PIE amazing is our teachers’ ability to teach lessons both in and out of the classroom. One such example is a class project/initiative from Ms. Jennifer Cann’s second-grade classroom.”
“Over the Christmas holiday I saw on Facebook that someone was making blessing bags and keeping them in their cars until they saw a homeless person in need of food or other necessities,” Ms. Cann said. “This project really touched me and I felt this would be a great service project for my students. I talked to the class about this and they were super excited to start collecting items for our blessing bags. The kids got right to work and their generosity was amazing.
