In 1936, Justice Owen Roberts in
U.S. v. Butler famously described the judicial duty of determining a law s constitutionality: to lay the article of the Constitution which is invoked beside the statute which is challenged and to decide whether the latter squares with the former. Though sometimes derided as mechanical and simplistic, this description captures nicely the essence of constitutional judgment, one fully in accord with the understanding of the greatest of our judges, Chief Justice John Marshall. In the case of the impending impeachment trial of President Donald Trump, Justice Roberts s words illuminate the fatal constitutional defect of this flawed and rushed attempt to mask mob rule behind the guise of constitutionalism.

THE DEMOCRATS WEIRD, TIME CAPSULE ARTICLE OF IMPEACHMENT. A lot has changed in the last two weeks. President Donald Trump has become former President Donald Trump. President-elect Joe Biden has become President Joe Biden. The former president has moved to Florida. The new president, in the White House, has begun to dismantle many of the executive actions of his predecessor.
And yet, on Monday evening, several members of the House of Representatives delivered to the Senate an article of impeachment that reads as if Trump were still president. It starts off like this:

U.S. Rep. Tim Walberg was not among the 10 Republicans who sided with Democrats when the US House of Representatives voted to impeach President Donald Trump for high crimes and misdemeanors relating to his role in last week s attack on the Capitol.
Rep. Walberg, R-Tipton, represents Michigan s 7th Congressional District, which includes the City of Saline, and the townships of Lodi, York and Saline. Democrat Debbie Dingell, D-Dearborn, voted for impeachment. Dingell represents Michigan s 12th Congressional District, which includes Ann Arbor and Pittsfield Township.
Walberg, in a Facebook post, said the violence at the Capitol was sickening and must be condemned, but said a rushed impeachment would deepen the nation s turmoil.

The House has impeached Donald Trump for an embarrassing and historic second time for the traitorous crime of incitement of insurrection in which he encouraged his simpleton followers to storm the nation s Capitol, which led to the deaths of five, including one police officer. Even better, along with 222 Democrats, 10 Republicans (not heroes, just buttholes who happened to do a single, decent thing) voted in favor of impeachment, which may not sound like a lot but it s a clear signal that the GOP s lockstep with Trump is definitely stumbling.
