Joining me now cnn contributor and law professor steve vladik. nice to have you here. steve, welcome back. congratulations on the birth of your daughter. thanks. great to be with you. good to have you here. i want your response to something the president has said over and over again. he just tweeted that hiring thousands of judges and going through a long complicated legal process will not work. this is after over the weekend he essentially said something or did say something the sclu calls unconstitutional and that is to deny due process to the migrants. clarify for us what the courts have said about the legal rights that even undocumented immigrants have. going back to 1896 the supreme court has been clear that even for undocumented immigrants once they are physically present in the united states they are protected by the due process clause.
Organization is working with? there are a number of them that you and your colleagues represent. can you just share with us what you have seen, for example, in the last few weeks in terms of children being separated from their parents, the age, the condition of these children. what has changed? poppy, i think what we are seeing is a complete change in who we are representing because we are representing very young children that have suffered severe trauma being separated from their families. so they are ranging in age from infants to teenagers. and they miss their families. so it s become very difficult because as an advocate you want to be able to hear their stories and then advocate on their behalf but getting those stories out is really difficult. what we have learned, steve, over the weekend is that the administration and dhs did look if the parents are willing to go back now over the
End of the day that the statute is relevant to the ultimate legality. at this stage when the question is just whether it should be on hold, i think it s not right to criticize the ninth circuit for focusing on the potential for harm as opposed to the ultimate answer on the merits. steve, let s go ahead and look at the merits of this executive order because the president says he s on strong standing, strong footing for supporting the merits of it. and this is from the appeal to block the ban. this is from the government, from the department of justice, unlike the president, courts do not have access to classified information about the threat posed by terrorist organizations operating in particular nations. the effort of those organizations to infiltrate the united states or gaps in the vetting process therefore saying that the judges cannot know enough because they don t have access to the classified information to make an educated decision about whether or not this ban should stand.
