We re really looking specifically who they re focused on, who is the defendant in whatever action they re going to take because historically when you want to challenge an over restrictive abortion law you would traditionally go after the government, the one who would be enforcing punishment for anyone that violated the law. Here the law is designed so it is not the government that imposes punishment. Every citizen is deputized to bring an action. That s why it is difficult to bring a challenge against the law. Even if you succeed in getting temporary or permanent relief against one person, you have all of these other people that can potentially sue these providers, which is right now providers say they re not performing abortions after six weeks.
