Tennessee Judge Finds No Sovereign Immunity for Defendant in Hospital Contract Breach Case

Health your username 5 days ago Judge Eli Richardson of the Middle District of Tennessee on Monday denied a motion to dismiss by South Carolina-based Medical University Hospital Authority (MUHA) in a suit alleging that the defendant breached an agreement with plaintiffs CHS/Community Health Systems Inc. and CHSOSC LLC stipulating that the defendant would purchase the assets of four hospitals. The plaintiffs alleged in their complaint that the defendant breached their agreement by failing to pay the full agreed-upon price of the transaction and failing to pass on communications regarding seller cost reports, among other allegations, according to the court.

Law firm Riley Warnock & Jacobson has elevated one attorney to member and added another as an associate. Andrew Curtis, who joined the firm in 2013, is a new member of the firm. He practices commercial litigation and graduated from Vanderbilt Law School. He was a U.S. Marine prior to law school. Riley Warnock & Jacobson has added Grace Peck as an associate. She recently graduated from Belmont University College of Law, where she was executive editor for the Belmont Law Review. She also attended Belmont for undergrad and was campaign manager to state Rep. Jason Powell before attending law school. Peck practices commercial and health care litigation.

Abelow named president of Nashville Bar Association Friday, December 25, 2020, Vol. 44, No. 52 Mike Abelow, member at Sherrard Roe Voigt and Harbison, has been named 2021 president of the Nashville Bar Association. Abelow litigates complex business disputes, with a focus on business disputes that involve either party threatening to or filing for bankruptcy. He was a litigator with the Federal Trade Commission before moving to Nashville in 2007. Before becoming a board member of the NBA, Mike chaired the Federal Courts Committee and the Sister Cities Committee. In addition to his work with the NBA, he is a board member of the Tennessee Justice Center, which he served as board president, the Nashville Urban Debate League and Seven Hills Swim and Tennis Club.
