(CN) Minnesota’s highest court unanimously upheld the state’s nonconsensual-porn statute Wednesday, bringing holiday cheer to privacy advocates and a year-end letdown to free-speech groups. The court found that the statute, which has been embroiled in litigation since its passage in 2016, criminalizes constitutionally protected speech but is focused tightly enough on preventing the nonconsensual dissemination of explicit images to stand up to strict scrutiny. “The constitutional right to free speech stands as a bedrock for our democracy,” Justice Natalie Hudson wrote in the 26-page opinion. “To protect this fundamental promise, we evaluate any encroachment on free speech with both caution and skepticism.”

Brothers Stein and Corey Agee of Canton and Atlanta, Ga., respectively, worked with clients between 2013 and 2019 to arrange $1.2 billion in fraudulent charitable contributions, and received $1.7 million in commissions, a statement from Richard Zuckerman, deputy assistant attorney general for the Department of Justice s tax division said.

The lawsuit has not yet been fully resolved and is being handled by U.S. District Court Chief Judge Roberto Lange. But most of the issue has already been taken up earlier this year in another federal court case. A judge in the Northern District of California ruled in favor of two California plaintiffs on Sept. 24 granting class-action certification and a preliminary injunction to stop the federal government from excluding incarcerated people from CARES Act funding.
