(AP Photo/Andrew Harnik) ATLANTA (CN) A national landlord group brought its case challenging a federal directive halting residential evictions to the 11 th Circuit on Friday, arguing that the order has forced landlords to give unlimited free housing to delinquent tenants without proper legal recourse. Attorney Caleb Kruckenberg of the New Civil Liberties Alliance told a three-judge panel of the Atlanta-based appeals court that the Centers for Disease Control and Prevention’s nationwide eviction moratorium has left his clients, the National Apartment Association and landlords in four states, without “any meaningful remedy” to evict tenants who fail to pay rent. ....

(Courthouse News photo/Nick Rummell) ATLANTA (CN) Home Depot asked an 11th Circuit panel Friday to overturn an order requiring it to pay $15.3 million in fees and expenses to lawyers who litigated a class action case against the retailer for a 2014 credit card data breach affecting 56 million customers. The original $15.3 million award was handed down by an Atlanta federal judge in 2017 but the 11th Circuit scrapped it last year, finding that the award improperly included a multiplier that enhanced the fees as compensation for the litigation risk assumed by the attorneys. ....

Ashley Palmer of the Fulton County Attorney’s Office told a three-judge panel of the Atlanta-appeals court that the lower court overstepped its authority by requiring Fulton County Sheriff Theodore Jackson and South Fulton Municipal Regional Jail officials to offer mentally disabled prisoners held in solitary confinement at least four hours of out-of-cell time per day. ....
