This morning, attorneys for hunter biden say their plea deal with the justice department is still, quote, valid is binding. and they say that a trial for the president s son is not inevitable. this falls the decision to grant special counsel status to the attorney investigating biden, the u.s. attorney, david weiss. kara scannell has the latest for us. kara? so this new filing yesterday from hunter biden s legal team shows that they re not just going to go quietly on this move by the by david weiss, the special counsel, to scrap what plans they had in place. they re saying that the deal they had on a gun possession charge is valid and binding. they re arguing to the judge that that should still stand. that was a 24-month period where a gun felony charge would be dismissed if biden agreed to certain conditions. they re saying that is still in place. now prosecutors told the judge that they had reached an impasse
Case is about, what the alleged crime is that hunter biden is pleading guilty to, and then the judge will have the opportunity to ask hunter biden questions. that s a pretty formulaic part of this process but we don t know exactly what hunter biden will say in response to those questions but she will want to make sure that he knows that he is pleading guilty to these charges and what he is pleading guilty to. now, we also expect to learn more about this plea agreement. our sources tell us that as part of the tax misdemeanor charges prosecutors have agreed to recommend probation, that is a no prison sentence. each of those misdemeanors carry as much as 12 months in prison and the gun felony charge could have as much as ten years in prison. because of the program if hunter biden agrees to the terms of it he will not have any prison time. we will learn more details about just what this plea agreement s this is a first in a year of firsts, it s the first time an american president s son is
