so interesting. whitney, thanks for laying it out. i really appreciate it. former federal prosecutor jennifer rogers. i kind of have this feeling, there have been a lot of court filings when it comes to this entire thing. how significant do you think this one is, as whitney was getting to? i think it s important for a couple of reasons. one, it s a well done filing. i think they re going to get what they re seeking which is to see these emails between john eastman and other folks, for example, as they try to overturn the election results and i think that will help their investigation but number two, it kind of sends a signal, right, to the republic and the doj that they re not doing it yet but the select committee is saying here implicitly, they re going to seek a criminal referral and set out in their report that supports the bringing of criminal charges and bring that report to the doj. what do you think the department of justice then does with this? that s the $10,000 questi
don t know for sure. what s the consideration for the justice department, do you think? the problem is because congress isn t the victim here as it would be in the case of criminal contempt, they don t really give it as much weight. certainly, they will be looking at the evidence the select committee has been gathering and that will be important to them but the fact of the criminal referral i don t think carries a lot of weight with the doj but the building of the facts happening over months and over months will compel them. it s all about attorney/client privilege. this part of it. people generally understand that, of course, but the committee is pointing to the crime fraud exemption which i think, better if you explain it rather than me. if there is an attorney/client privilege and one thing the committee is saying there s not a legitimate privilege but if there were, it can be initiated if the purpose of the communication was to enhance or further an ongoing crime or planned
