The alleged victim has her own history with alcohol abuse, and Schweizer once obtained a restraining order against her several years ago, Palazzo said. Most telling in the restraining order is that the alleged victim indicated if he slept in the living room, she would call the police and falsely accuse him of rape, Palazzo said. So she already has the basis to make a false accusation. Palazzo said the woman declined to give police a written statement at the scene of the alleged rape on April 21. New Jersey Herald State police charged Ian Schweizer, 38, with simple assault after the alleged April 21 incident, but at a virtual court hearing on Tuesday, a prosecutor said Schweizer would also face four additional counts of sexual and aggravated assault. A hearing to determine whether he will stay in jail while the case is heard, originally scheduled for Thursday, was postponed until next week. The incident comes a month after the state Attorney General s Office issued a report concluding there was a breakdown in communication between state police and the Sussex prosecutors over the 2017 allegations, but no signs of improper or corrupt influence. Some troopers from the Sussex barracks had claimed Schweizer s family connections had played a role in the dismissal of the charges.
