The Aurangabad bench of the Bombay High Court recently observed that it would amount to marital cruelty if false and baseless reports were lodged with the police against one's spouse and his family relatives.
The Court was astonished to note from the evidence that a minor victim of 6 years was made to appear in jail premises in order to identify the culprit amongst a line of dummies and she was asked to touch the perpetrator.
Petitioner seems interested only in initiating cases against the public officers and keeping them pending like Sword of Damocles, the Aurangabad bench remarked in its order.
The Aurangabad Bench noted that the accused failed to show what animosity the police or the victim’s family had against him to tutor the minor rape victim to take his nickname over anybody else.
The Bombay High Court issued directions to the State to implement its policy decision to withdraw pending criminal cases against farmers and social activists.
