The Naked Cowboy is asking a judge to allow him to withdraw his no contest plea in his controversial arrest during Bike Week, and his attorney has sent a letter saying he plans to sue the Daytona Beach Police Department.
But Police Chief Jakari Young responded that the street performer made a racist comment during his arrest about Vice President Kamala Harris.
The Naked Cowboy, aka Robert Burck, 50, pleaded no contest to a charge of resisting arrest without violence. because he was under duress, according to the motion filed by his defense attorney John Phillips. ....

Naked Cowboy plans to sue Daytona Beach; police say he used n-word


Told of Burck’s threat to sue the Police Department, Chief Young said in a phone interview that given all that was happening across the country, including active shooters, police reform and officer-involved shootings of unarmed people, the Naked Cowboy was not high on his list of priorities.
“If this is all we have to talk about is the Naked Cowboy I think we are doing pretty good,” Young said.
Asked about allegations in the motion filed by Phillips that Daytona Beach Police officers had mocked Burck’s anatomy after his arrest, Young said he had never heard that and said Burck was saying that to distract from his own comments. ....

Report: State Department security officer arrested for impersonating police officer


The incident occurred at 9 p.m. Tuesday at Clayton Drive and Bluebird Terrace, deputies said.
The 43-year-old victim was westbound on Clayton Drive when he came upon another vehicle parked on the side of the road. The motorist tried to go around it by getting into the eastbound lane but came face to face with Land’s GMC pickup that was eastbound on Clayton, deputies said.
Land stopped his vehicle in the middle of the road, preventing the victim from continuing. The victim could not use the westbound lane because of the other vehicle on the side of the road, a report shows. ....

Man Threatens Customers & Employees With Sword

Daytona Beach, FL - A Palm Coast man is facing multiple aggravated assault charges after police and witnesses say he brandished a sword and threatened everyone inside the store. According to a police report obtained by News Daytona Beach, 29-year-old Marcus Smith entered a Sunoco convenience store on International Speedway Boulevard (ISB) Monday night (May 3) and reportedly made comments about how he should steal from the store. Afterwards, Smith took the soda and went to pay for it, but the comments continued. Police say Smith continued to make remarks at the victims before pulling a sword out of his backpack, which he began to threaten customers and employees with. After brandishing the sword, Smith took off out of the store and ran westbound onto ISB. Security footage obtained by police also showed Smith getting into an argument before holding the sword above his head, prior to him leaving. Man in Volusia jail for probation violation in killing dies of COVID


Timothy Lee Whistler avoided a possible death sentence for beating a psychic to death with a Champagne bottle in Cassadaga a quarter century ago.
Whistler pleaded guilty to a lesser charge of second-degree murder in Volusia County Circuit Court, served about 20 years in state prison and was released in 2016. He then moved to Missouri to live with his wife and began serving his 20 years of probation.
But in February, he was arrested in Missouri on a charge of driving while intoxicated, a violation of his probation. 
The 49-year-old Whistler was extradited back to the Volusia County Branch Jail and that’s when COVID-19 became a death sentence he could not avoid. ....
