Kota Kinabalu: The Sabah Law Society (SLS) says the new fake news law related to Covid-19 and the emergency proclamation may see the “rule of law descending into rule by law”.
Its president Roger Chin said while it agrees that it is important to stop any false information relating to Covid-19, the scope of the definition in the new law gives the impression that fake news is not the real target. ....

During this Covid-19 pandemic the government has set up Pusat Mediasi Covid-19 (“PMC-19) to deal with any contractual disputes as a result of the lockdown under the Prevention of disease Act. The PMC-19 offers free mediation to members of the public.  Their mediation services can be accessed online via the following link.  
Many people still do not know what is mediation and therefore do not know how to take advantage of this offer by the government.  I will attempt to explain this process in layman terms. 
Mediation is a process which is very different from the court process that we know.  A mediator must complete a 40 hours course and pass the assessment before he or she can act as a mediator. Unlike a judge, a mediator does not decide or rule on a case. The mediator will help the parties to talk about their grievances and narrow down the issues.  The mediator is not there to give legal advice or to impose a ....

Kota Kinabalu: Lawyers doubt the effectiveness of a pre-signed letter by Sebatik Assemblyman Hassan Gani Amir
(pic), which states that he would deem to have vacated his seat after he left Parti Warisan Sabah.
The lawyers said the letter would likely not be enforceable by court due to freedom of association laws in Malaysia, and that the State Assembly can choose to disregard the letter.
“As we know, any contract which prevents switching parties is unenforceable. Any promise he made to resign cannot be enforced against him because it violates Article 10, which provides for freedom of association – it is an unenforceable promise,” said lawyer New Sin Yew. ....
