Kerala HC declines interim stay on state govt's rummy ban

A handful of companies, PlayGames 24X7, Junglee Games, Head Digital Works and Gameskraft, last week moved the Kerala High Court challenging the state government’s ban on online rummy involving stakes. While the companies had sought interim relief seeking a stay on the notification, the court denied this and instead scheduled the next hearing for May 20. LiveLaw first reported the order.

A Single Bench of
Justice Ajay Bhanot laid down the procedure to be adopted by the competent authority for inquiring into the criminal antecedents of a candidate for the purpose of selection. It elucidated the type of materials that may be considered by such authority, the standard of proof, and other aggravating/ mitigating factors for the purpose.
The Bench also made it clear that such inquiry is different from a trial/civil proceeding before a Court of law and hence, competent authority is not always bound by the findings of the court, nor is it invariably constrained by the opinion of the investigation officer. The order came on a writ petition filed by one Sanny Kumar, aggrieved by an order passed by the Superintendent of Police, Jalaun, cancelling his selection as Constable in the UP Police, in the backdrop of several criminal cases pending against him. ....

Kochi, April 8 : A few online gaming companies on Thursday got a jolt, when the Kerala High Court refused to stay the state government s February 23 notification under Section 14A of the Kerala Gaming Act, 1960 clarifying that online rummy when played for stakes does not enjoy exemption from the general prohibition of gaming and gambling.
A few online gaming companies had sought a stay on the Kerala Government s order, but failed to get it.
The Court however asked the Kerala Government to file its statement and posted the case for May 29. ....

The Kerala High Court on Thursday, refused to interfere with a Kerala Government Notification banning online playing of rummy when played for stakes .
Upon a challenge made by four gaming companies, a Single Bench of Justice
N Nagaresh expressed his disinclination to interfere with the notification at this juncture an d instead listed the petition after the vacation. However, upon a submission made by Advocate
Santosh Mathew appearing for one of the petitioners that any coercive action taken by police would cause irreparable damage to the company, the court allowed the petitioner to approach the court even during vacation if coercive steps including criminal action was resorted against them when the cases were pending disposal. ....
