A Quebec Superior Court judge will hear Montgomery’s court challenge in early October, but her lawyer argued Tuesday that having her serve her suspension before then would be unjust.

“You can’t punish her before she’s exhausted all the recourses she has to get her arguments across,” lawyer Eric Oliver told reporters at the Montreal courthouse.
Quebec Superior Court Judge Mark Phillips heard both parties’ arguments and is expected to rule on whether to stay the suspension in the coming days.
