we have just learned it's cleared, it was blocking two right lanes. a new issue though, some emergency road work, that is going to be on northbound belair road at 695, the northbound ramp to the inner loop of the beltway is blocked for emergency road work. that detour is posted. otherwise speeds on the beltway looking great. same for 95 southbound between whitemarsh and the tunnel. west side of the beltway still smooth at exit 17 and there's 95 just south of maryland 22 where we had that earlier accident, everything running smoothly. now wjz has the stories people are talking about. don? the case of a much talked about local cardiologist is now in the hands of a jury. wjz's mike schuh live outside the courthouse in towson. good morning. >> reporter: good morning. a high-profile developer says that this surgery was unnecessary and cost him $50 million. now he's asking a jury here to give it back. after dr. mark midei, the hospital's former catheterization lab director was accused of giving patients unnecessary cardiac stents. >> dr. midei said it was 90%. after they reviewed everything it was 10%. >> reporter: those percentages refer to blockages in blood vessels. the higher the number the greater the need for a stent. the case dates back to 2009 when letters were first mailed to dr. midei's patients including businessman glen weinberg, a partner of the company behind such large developments like the maryland live casino. weinberg's case is now being heard in baltimore county circuit court. he claims he lost about $50 million after scaling back his business to deal with matters of the heart. after being diagnosed by dr. midei. in court monday weinberg's attorney told the jury -- >> reporter: last week dr. midei testified weinberg would have died without the procedure, midei's attorney also fired back saying tests clearly showed weinberg had unknowingly suffered a heart attack and "there were abnormal changes to the heart." dr. midei was an independent contractor and had been head of st. joseph's catheterization lab since 1995 where he performed thousands of cardiac stent operations. >> what i is it was what i would -- did was what i would want for anyone in my own family. they were treated appropriately and with the highest regard for their well being. >> reporter: he since resigned from the hospital which also is listed in the $150 million lawsuit. he resigned in 2009. the hospital now has a new owner. i'm mike schuh reporting live in towson. back to you. >> thank you very much. midei's medical license was revoked in 2011. in washington, dc the president says problems with the web site for the affordable care act will be fixed and that everyone who wants to get health insurance will be able to do so soon. the president spoke from the rose garden after three weeks of computer glitches with healthcare.gov. the white house says more than 19 million people visited that site and yes many have experienced problems and delays. >> the problem has been that the web site that is supposed to make it easy to apply for and purchase the insurance is not working the way it should for everybody. there's no sugar-coating it. >> republicans in congress say fixing the web site won't fix their problems with the fort -- affordable care act. a school shooting in sparks, nevada. police say the child that brought a gun to school is one of the two dead there. >> reporter: dozens found the strength to attend a vigil last night for math teacher michael landsberry, killed during a school shooting near reno, nevada. >> he was like a second dad to me when i went there. he cared so much about the students. >> reporter: police say the 45-year-old military veteran tried to stop the 13-year-old gunman monday morning by telling him to lower his weapon but instead the teen shot landsberry in the chest. >> he said i would help you guys. i would do anything for you guys. i guess that meant taking a bullet. he did. >> reporter: landsberry's sister told reporters she's not surprised her brother lost his life trying to protect students. the shooting at sparks middle school started 7:15, law enforcement officials say they arrived within three minutes but by the time they got there the shooter had already wounded two students, killed landsberry and turn the gun on himself. >> he said you ruined my life and i'm going to ruin yours. >> reporter: police say it's too early to determine whether the 13-year-old student targeted specific people. jerika duncan, cbs news. >> the names of the student with the gun or two students he injured haven't been released. one of the students was shot in the shoulder, the other in the stomach. their injuries are said to be not life threatening. police say the 13-year-old used his parents' gun. we have some surveillance video from russia, a suicide bomber attacking a bus filled with people. and we should warn you some viewers may find the video disturbing. >> as you saw the bus burst into flames and smoke. fragments of what appear to be window frames and other parts of the bus scattered across the area. six are dead, more than 30 hurt. investigators say the suicide bomber was the wife of a russian islamic militant. a florida man who admits to stabbing his girlfriend 32 times has learned his fate. 22-year-old robert burton was sentenced to life in prison without the possibility of parole yesterday. police say he attacked melissa domey after she broke up with him last year. domey testified burton asked her for one last hug and began to stab her during that embrace. doctors say it is a miracle she survived. in montgomery county a 7-year-old is in critical condition after her mother hits her with their suv. police say 41-year-old wen ha song was backing up an suv like that one in potomac sunday night. she hit her little girl without knowing it, continued to the grocery store. that suv is equipped with a backup camera but police say she may have turned it off for a recent driving test. also caught on camera -- a copper thief striking a bge substation in anne arundel county. it's a dangerous growing problem for the utility and meghan mccorkell with more on the crime. >> reporter: good morning. the latest theft happened at a bge substation in gambrills thursday and officials say it's not the first time that facility has been targeted. police looking for this man who they say took a dangerous and sometimes deadly risk. investigators say he cut through a fence at this high voltage volt bge substation thursday, a facility that requires workers to wear flame retardant suits at all times. >> many times thieves can be severely or fatally injured. >> reporter: investigators say the man stole various amounts of copper, got away and it's not the first theft case here. bge has become a prime target for copper thieves with substations, even power poles being hit. >> we have cameras in many locations and we take other proactive steps and work very closely with local law enforcement. >> reporter: the fbi named copper theft a threat to critical infrastructure. according to the national insurance crime bureau between 2006 and 2008 nearly 14,000 metal thefts were reported. that number skyrocketed to more than 25,000 thefts between 2009 and 2012, 96% of the thefts involved copper. with the price of copper on the rise more are risking their lives to get it, that is why officials want this man caught. bge officials have started painting some of their copper wires bright green so that scrap metal dealers will now it's been stolen from the utility. meghan mccorkell, wjz eyewitness news. >> according to the department of copper energy -- copper thefts causes billions of dollars in losses every year. apple is slated to hold its latest media event in san francisco this afternoon. the tech giant is expected to showcase new products including a new and improved i-pad. it's just rumor for now. apple has told reporters there should be a lot to cover. in sports the ravens have an extra week to prepare for the next game. that means extra time to look at what is going on so far. john harbaugh criticized several players' poor play in the last few weeks. the team lost two straight and is now under .500 for the season. harbaugh talked about addressing team needs as they try to improve that record. >> we're going to do whatever it takes, trade guys, we'll cut guys, we'll sign guys, we'll coach guys. we'll change schemes. doesn't matter. we're going to find a way to get better. that's the business we're in. we got 6:25. one of the great landmarks is about to get a facelift. here's mary bubala with more. >> reporter: baltimore's washington monument offers amazing panoramic views of the the city, 178 feet above charles street but that view has been off limits for three years after the structure was deemed unsafe. the nonprofit organization in charge of the renovation takes us inside the monument today showing us how water leaks have weakened the structure, by rusting metal support brackets and hollowing out mortar. so scaffolding will go up encasing the outside of the monument as it undergoes a $5 million renovation. >> the monument is approaching its 200th birthday. with that in mind there's a lot of damage to the exterior basically caused by water. >> reporter: the mount vernon place conservancy is working in partnership with the city to guide the careful restoration of the city's historic jewel. >> you can really see all the damage that moisture has caused. there's just so much mortar that is crumbling out of all the joints here and so all of this needs to be stablized, you need to remove any mortar that is loose. >> reporter: the big question, will the city still be able to have its lighting of the monument to kick off the holiday season? >> three, two, one! but also getting busier. now wjz has the stories people are talking about. here's don. some 19 million people visited health care.gov since the web site opened three weeks ago but as you no doubt have heard there's been multiple problems. the president is now vowing changes. here's tara mergener reporting for wjz. >> reporter: house republicans get back to work today and want to know what went wrong with the government's web site consumers use to shop for health insurance plans. >> they told us over and over again that they were going to be ready. >> reporter: congressman fred upton, chairman of the house energy and commerce committee will hold a hearing thursday to look into the glitches. monday he issued a statement. it's time for all those responsible to explain what happened. >> there's no excuse for the problems. >> reporter: president obama is promising fixes. among the changes, a new feature called "see plans now" which shows the price of health insurance before opening an account. sources tell cbs news in late september the administration requested web site developers drop this shop first feature. house republicans say it was a political move to hide the sticker shock of health insurance costs. but president obama insists the insurance plans are affordable. >> in some cases actually it's exceeding expectations. the prices are lower than we expected, the choice is greater than we expected. >> reporter: the white house says $500,000 people applied but the administration won't say how many of them have been able to enroll. in washington, tara mergener, mergener wjz eyewitness news. the chairman of the republican party accuses the white house of hiding the real numbers and filed a freedom of information act request to find out exactly how many people have been able to enroll. a new york city police officer charged with taking part in a violent road rage incident will not testify before a grand jury. the undercover detective no longer wants to speak before the panel before it decides whether or not to indict him. fellow officers say the detective was part of a group of motorcyclists seen on surveillance video chasing and then beating an suv driver. attorneys for the officer say the video clearly shows he did not attack the driver. in our area -- a jury returns to the courthouse in towson later today for the case of dr. mark midei. wjz stabbing in northwest baltimore. 30-year-old gabriel smith is charged with second degree murder in the death of letreesha gowdy. police say it happened on fairview avenue saturday. it's not clear what the motive may have been. a record 41 bears have been killed on the first day of the hunting season here in maryland. according to the media partner "the baltimore sun" it's the most productive first day since hunting was revived in 2004. the previous r0rd for the first day -- record for the first day was 38. the first bear taken was also the biggest so far, a 315-pounder. a former hooters employee files a racial discrimination suit against her employer. it centers around her hair. here's derek valcourt with the story. >> reporter: good morning. specifically that complaint alleges that white waitresses at hooters are allowed to have highlights in their hair but black waitresses are not. 25-year-old barren johnson's blonde highlights at the center of this complaint filed with the maryland commission on civil rights. >> my other co-workers all had different colors in their hair like red and blonde highlights. i didn't think it would be an issue. >> reporter: johnson was fired from her job as a waitress at baltimore's harborplace hooters in august after managers told her her hair color violated employee image standards. >> they specifically said black women don't have blonde in their hair so you need to take it out. >> reporter: jessica webber is her attorney. >> what is wrong is federal and state law clearly say that employers can't include two separate and distinct rules governing employee standards, one for african-americans and one for everyone else. that is exactly what hooters did here. >> why don't we just not define hairstyles for anyone? >> reporter: baltimore delegate mary washington agrees employers need to be able to define personal appearance and grooming standards but she's already drafting legislation that would prevent employers from requiring or prohibiting specific hairstyles. she says johnson is just one of many examples. >> also there's some women and men who are told to dye their hair, that if they are gray somehow they don't -- they are not projecting a youthful image. so i think really further clarifying hair and restricting employers from doing that will help all kinds of people. >> reporter: for their part hooters declined to comment citing the pending litigation. the case is now in the hands of the maryland commission for civil rights who's investigation could take months. at the inner harbor, derek valcourt, wjz eyewitness news. >> delegate washington expects to prefile her bill before the next legislative session in annapolis. a longtime tradition is coming back. the annual bay bridge walk was cancelled several years ago. now a private company is bringing a version of it back. a 10k race across the bridge will be held on november 9th of next year. with the registration beginning next month. three charities will benefit from the race. the chesapeake bay foundation, yellow ribbon fund and bosom bundyies. turning to football the new york giants get their first win of the season. it only took seven weeks. the g-men and the vikings were on "monday night football" last evening. the giants made several big place but also they took advantage of the struggling minnesota offense, the giants with several interceptions on the night and go on to win 23-7. as far as the ravens go the team has an extra week to prepare for the next game. that brings extra scrutiny and talk. john harbaugh pulled no punches yesterday as he criticized several players for poor play the last few weeks. the team lost its last two straight and now is under point 500 on the season and yesterday there was talk [ applause ] >> thank you, it's an honor to be here. i'm thrilled. >> i can tell. >> let me ask you this. when did being the director -- when did the title of spokesperson for the movie hit your job category being the director? >> you know, i guess it's my fault if you will. you like it -- it's all coming to me, if not i guess i take the blame. we're sort of the, the captain, we rally our troops and go into battle and hopefully a very funny movie comes out on the other side. i think we did it this time. >> what's interesting, you're not the first director we've had on because a movie has gone to blu ray dvd. i agree with your explanation. the buck stops right there. >> all i know is that an audience at home is never more excited when a director is on tv. [ laughter ] try to control your enthusiasm, everybody. manage it. >> look at it this way, blu ray/dvd, whatever genre, it's the director's cut, with the initial selling point of all of these - >> see what you missed. >> exactly. for me, what i love about the blu ray because i feel like my director's cut what is played in the theater, i love the movie. for the unrated we put in a few things we were always on the fence about that we liked but didn't have time for. those are in but what i love most about the blue ray and dvd and all the extra, tons of extra outtakes, alternate scenes, of just strings of jokes and improvs that people did. then there's five, count them, five commentary tracks including, i don't know if you're a fan of the old mystery science theater 3,000 show but we got the original guys from mystery science 3,000 to make fun of the movie on one of the tracks. >> it's awesome. that is cool. >> it's fun. very fun. i was happy to be made fun of by those gentleman. >> take us inside the ropes for a second. does a studio tell you is this is how much time you have on screen? not unlike a tv show? >> well -- they have a target they would like to hit. they don't -- they especially don't want things to be over two hours long. i agree, i don't want a comedy to generally be that long. "brides maids," the last one before this went a little longer than two hours but we always judge it by the fact at how the audience is responding. we do test screenings to make sure we're not boring people. and we'll make it as long as the audience will stay with us. yeah, you don't want to go forever. also it limits how many times they can show the movies in the theaters. anywhere between 90 minutes and two hours is their sweet spot. 1:45, one hour and 45 is the perfect length. >> i've got a question. your movie was out last summer, a big hit, now on dvd. many are coming out on dvd and blu ray and on demand the same day they come out in theaters. in some cases - >> yeah. >> on demand is coming out before theaters. what is the theory behind that? >> well, it depends on the size of the movie. i think it's a good thing because there's a lot of little movies that you don't necessarily get motivated to get in the car and pay all your money to go to the theater and pay for parking and get all the food versus if you're going to go, that looks interesting and say i can just kind of go on my cable box and get it for a nominal price, maybe we'll do that and stay home. i think it's great especially for smaller films that are fighting to find their place in the marketplace. you never are going to see "pacific rim" or something like that.
