We are looking at busy traffic. We will start off at the bay bridge toll plaza. You can see traffic is queuing up. It is about a 15 minute delay before you make it into the city. No major problems on the bridge but there is a lot of waiting. We get a little bit of a break as some have a spring break this week. Lets move on and look at highway 101 in San Francisco. It doesnt look okay approaching the 80 split with no major issues. Southbound 280 near bascom avenue, highway 17, a big rig and car accident. One vehicle is flipped over. It is not causing a big delay because it is in the non commute direction. 601, lets go back to the desk. We continue to follow a developing story, a shooting in South Berkeley that happened early this morning. Alex savidge has been on scene trying to get more information this morning. Two people are very seriously hurt out there. Reporter thats what we know. Good morning. Demand and a woman both shot and critically injured in this berkeley neighborhood early this morning. You can see behind us, this is still a very active investigation with part of this neighborhood blocked off by crime scene tape as investigators gather evidence and continue to search for the shooter. I want to show you some video we shot a short time ago. This happened around 1 am. Berkeley Police Received reports of gunfire onto tremont street your prince street. This is about a block or so from the ashby bart station in South Berkeley. We do not know what prompted the shooting or what led up to the gunfire. The man and the woman were sitting inside the white car. Some of the windows were shattered. We do not know what the motive was for the shooting. We are waiting to find out if police have a description on the shooter who was involved or any sort of getaway car. We have put in calls to a spokesperson for the Berkeley Police department looking for more information. As we get it, we will pass it along. The chp investigating another shooting on interstate 80. That happened around 5 45 pm near appian way in pinole. Chp said a woman was driving on interstate 80 chp said a woman was driving on interstate 81 someone drove up next to her, pointed a gun at her and fired several rounds. No one was hurt. This shooting is the latest in a string of freeway shootings along interstate 80. There have been eight similar incidents between pinole and berkeley since november. Two of those were deadly. Richmond police said the shootings are between feuding gang members from richmond. To deadly crashes within two hours being investigated in the south bay. The first was around 10 45 pm. Highway 85, north of winchester boulevard. Chp said a pedestrian was hit and killed by a vehicle. We do not know why the pedestrian was on the highway. After 12 30 am, chp responded to it deadly rollover crash on highway 9 near austin way in saratoga. The corner was called out around 1 30 pm a. M. We do not know why the car crash. Today marks a people anniversary for a family and southern Santa Clara County. Sierra lamar disappeared on her way to school for years ago today. She left her morgan hill home to catch a bus. Even the police have not found a body, they arrested antolin garciatorres on murder charges, based on dna evidence. Sierras father said the family is still filled with sorrow, pain and unanswered questions. Pretty much the same state yes, year after year. Its a nightmare. My heart will always go out to the family, to the friends come into the community. Sierras family said they have pleaded with garciatorres to Say Something that would lead investigators to sierra that he has so far remained silent. His trial is set to begin next month. Hillary clinton may still be celebrating after some big primary election wins yesterday. On the republican side, things are still not clear in some ways. He delivered his winner take all homestate and brushback donald trump. We will bes Hillary Clinton and i will become the president of the united states. Reporter big talk but this is kasichs first and only went so far. It makes it much more difficult for trump to win the nomination outright, making a contested convention this summer more likely. Trump appearing in florida last night and could claim some big wins, especially in that state. To win by that kind of a number is incredible. Reporter the casualty, marco rubio. Despite pledging to keep running no matter what, he suspended his campaign after a trump trouncing in his home state. The fact that ive come this far is evidence of how special america truly is. Reporter delegate wise, ted cruz remains in second place and he is hoping for a twoman race with trump. Hillary clinton went a long way to locking down the democratic nomination and made it confident pivots, attacking republicans. Our commanderinchief has to be able to defend our country, not embarrass it. Reporter but Bernie Sanders who has been a persistent thorn in Sanders Clinton side said not to count him out. He is looking ahead to arizona. We will win if the voter turn out is high. That is one of the next states coming up. This morning, donald trump just said that he will not be doing that debate. This would be the second gop debate that he is going to skip out on. We will see how that plays out. Governor jerry brown is getting attention on social media after he weighed in on the republican president ial race. On monday, the governor said that if donald trump is elected president , california may have to build a wall to quote, defend ourselves from the rest of this country. The Sacramento Bee reports Governor Brown followed up by saying, that was a joke. He said, we dont like walls, we like bridges. Palo alto needs help to find a man accused of exposing himself to a girl. Police released this sketch. The suspect is described as a white man between 25 and 30 years old the skinny build, black, wavy hair down to his neck. The girl was walking her dog monday night in the area of melville avenue and middlefield road when the man exposed himself. If you have any information, please contact police. San francisco is exploring the idea of extending parking meter hours at night. Transit officials brought up the idea yesterday as one way to raise more revenue. Right now, the only plan to study the impact of extending hate metered parking beyond 6 pm and it would only apply to the busier parts of San Francisco. The sf mta is facing a 13 million deficit next year. Also, they agreed to significantly reduce towing fees which is another revenue loss for that agency. Temperatures will be above average. From north korea, an American College student was just sentenced to 15 years in prison and north korea. Otto warmbier was sentenced by north koreas highest court to 15 years with hard labor. This comes weeks after hugh tearfully confessed that he tried to steal a political propaganda poster from a north korean hotel. He was arrested in january, charged with subversion. Warmbier is an undergrad from the university of virginia. He was a north korea with a new years tour group. There is a new revelation showing the lack of cooperation between federal agencies in the wake of the San Bernardino mass shooting last year. Administrators in Immigration Customs Enforcement Agency appeared before a Senate Committee yesterday. They acknowledged that a day after the terrorist attack, a Security Team tried to intercept Enrique Marquez and his russian born wife at a citizenship and Immigration Services office. Marquez was a friend of the attackers. A worker at the office would not allow the Security Team to enter the building. He wanted to check with his boss first. Do we need to look at our protocols to make sure that those misunderstandings dont occur . That may well be something we need to do that there was never an actual intent to prevent them from doing what they needed to do. Marquez and his wife never showed up for the meeting but critics say the clash between agencies is troubling. Marquez is facing charges including conspiring to provide Material Support to terrorists. Turning to continuing legal battle between apple and the federal government over hacking the iphone of one of the San Bernardino shooters. Apple filed a brief claiming the governments actions would up all the nations founding fathers. Apple argued the federal government is violating the constitution by trying to broaden the authority of a 227 yearold law. Apple said all the San Bernardino attack was tragic, government expediency should not stomp all over civil liberties. Google said it is making progress in its in protecting its Research Engine from hackers. They announced yesterday that 77 of the requests sent to its data centers are encrypted. That is up from 52 at the end of 2013. Google said its most secure services, gmail, which is completely encrypted, is both the sender and receiver use gmail. Santa clara county, an investigation is underway into the death of a foster child who was sent to live with her father. According to the mercury news coming the girl suffer from a rare birth defect. She was found unresponsive late last month. Girls death came two months after the county allowed her back into her fathers care, who was living in a transitional home for recovering drug addicts. The case is not being treated as a homicide that an autopsy is being conducted to determine how the girl died. The county foster care system is reviewing the case. A San Francisco federal Appeals Court threw out a lawsuit filed by kidnapping figured, dc dugard against the federal government. She accused federal parole officers of not properly supervising Phillip Garrido when he was on parole for another kidnapping in the years before she was abducted. In 1991, guido and his wife abducted jc dugard, she was held captive in the backyard shed after ritas home in antioch for 18 years. Sexually abusing her and she gave birth to two daughters. The Appeals Court ruled that she cannot sue over what parole officers did or did not do in the years before she was kidnapped because it she was not your readers victim at the time. If you are driving this morning on the san mateo bridge, it does look like it is a little slow heading out to the peninsula. In the south bay, despite the accident we had onto 80 southbound in 17, we have not had a lot of slow traffic. Northbound 101 is slow approaching 880. Lets go back to the desk. Developing news from berkeley where two people were shot early this morning. Police say a man and woman sitting in a car were shot. Several bullet holes hit the car and look at the aftermath. Both victims in critical condition. Police do not know of a motive yet or a description of a suspect or suspects. Alex savidge will have an update coming up in our next half hour. Also, a man is fighting for his life after a shooting in broad daylight. This happened around 11 30 am at san pablo avenue and delaware street. The 28yearold victim was hit at least once by bullets. The berkeley swat team shut down the neighborhood, searching for the gunman. People were asked to shelter in place. That shooter is still on the loose this morning. Police believe the shooting stemmed from some kind of altercation. About an hour and a half from now, president obama is scheduled to announce his nominee for the u. S. Supreme court. Brian flores joins us with he was on the list and the reason Republican Leaders say they will block the confirmation hearing. Reporter leaders like Mitch Mcconnell have said that they will block any hearing or so Court Justice replacement saying the next president should make that decision. They are betting on the hope that a republican is voted as president. President obama hopes some of the potential nominees will appeal to both sides of the aisle. Reportedly, the president is likely to nominate either judge Sri Srinivasan, judge Merrick Garland, or judge Sri Srinivasan two. Sri srinivasan and Merrick Garland are serving on the u. S. Court of appeals for the district of columbia. Watford is a judge on the ninth Circuit Court of appeals based in San Francisco. The president announced he had reached a decision and did not name any nominee specifically but he did say that he reached out to every member of the senate and consulted with legal apps are experts. The president said the senate should have enough time to consider and hold hearings on a nominee but as mentioned, Republican Leaders who have the majority have vowed to block confirmation. The president has nominated two justices to the high court during his time in office. Those being Sonia Sotomayor in 2009 and elena kagan in 2010. This is a very delicate balance to select a nominee but coming up, we will talk about the nominees, some have bay area ties. And which one may appeal to both sides of the aisle. I am anxious to learn about that. Residents of san jose will have a chance to weigh in on how the city should regulate medical marijuana dispensaries. Allie rasmus is on live with us now. What is on the agenda tonight . Reporter the topics all have one thing in common, how should the city regulate the medical Marijuana Industry given that the industry and state laws about it they be changing. Especially if theres a referendum later this year to legalize recreational marijuana. Some Council Members have said it is a good idea for the city to get ahead of the state regulations. Tonight, the council will ask for public input. In medical marijuana meeting is scheduled for 630 tonight at city hall. They are talking about specific things when it comes to regulating the industry and dispensaries in the future. They include rules about how dispensaries grow and manufacture medical plot pot for multiple locations in the city and possibly throughout the state. Rules about dispensaries growing marijuana in greenhouses in san jose and also how to regulate the transport and delivery of marijuana between those different cultivation and manufacturing sites. The mayor said even though they are taking a look at rules and regulations of the industry going toward, he does not expect the number of dispensaries in the city to grow in the future. Right now, san jose has 16 dispensaries. Theres no question that if there is a dispensary thats on your street and you have a family, then there is one too many dispensaries in the city. The good news, we have kept them out of neighborhoods with this set of regulations. Really, out of the line of sight of kids, away from any sensitive receptors. Reporter later this month, the City Managers Office will come back to the council with a report on some of the items and topics they discussed tonight. They will also give the council a report on whether the city should create a special division of medical marijuana control. A lot of issues moving forward they will be looking at. Back to you guys. The Oakland City Council approves selling a prime piece of property near lake merritt but not before protesters force Council Members to pull up stakes and move. The protesters dont like the citys plan to build a new tower on east 12th street that includes housing for both low and high income residents. Critics say the entire building should be affordable housing. This came up before and last time, new noisy protest shut down the meeting. This time, the council was ready to move to a smaller room to finish the work. This was not going to be hijacked. We were going to do the business that the voters of the city require us and expect for us to do. For them to sequester themselves and to have Police Officers guarding where they are and not allow the public and is actually a violation of the law. The city of oakland said it piped out audio of the meeting to the public and recorded it. Anyone can find out what was said. Leaders say the next step is working out a Sales Agreement that could be worth about 5 million. After that, the actual work on the tower project could start as early as next year. A wellknown chef who owns upscale restaurants in the bay area is being sued by two former employees for Sexual Harassment and labor violations. The women say Michael Chiarello and his management at chiarello made crude comments and homophobic and ethnic slurs, in a properly touched employees and mimicked sex acts with food. They say they were not paid for all the hours they worked or paid overtime and that time clocks and timesheets were manipulated. The lawyer said the allegations are unfounded and the chef is very upset. We are learning more about Sexual Harassment allegations against a cal assistant basketball coach fired this week. Uc berkeley said an internal investigation revealed Yann Hufnagel violated harassment policies. According to the report, he admitted to trying to more a female reporter to his apartment for sex. She told investigators he would text her repeatedly with sexual innuendos and when she refused his advances, denied her access to information she needed to do her job. Report said hufnagel acknowledged his conduct was inappropriate but did not constitute harassment. He told espn he was blindsided by the findings. A san rafael woman pled not guilty in an auto store robbery that led to a violent confrontation. A manager at the Oreilly Auto Parts store in san rafael suspected, tiffani monique shepard, shoplifting. When he confronted her, she threatened to shoot him. She escaped with merchandise on a bicycle. Police spotted her later that day and that is when they took her into custody. At the station they say she managed to pull a table lose that was bolted to the floor. Two weeks ago, someone stole a moving van used to transport the belongings of a blind man moving from the east bay to portland. Now the mans mother is asking whoever stole the items to please return them. The rental truck was stolen in Oakland Rockford neighborhood. A friend was going to drive the rental truck to portland to deliver the belongings. They included personal items and a vintage jewelry as well as family photos. My grandmothers picture when she was 21 years old. Its been in my family since the second world war. They took a blue suitcase that hard all of our family pictures in it. Her son, michael moore, is blind and disabled from diabetes. She estimates that 50,000 worth of items were stolen. The truck was recovered last week that it had been ransacked and abandon in east oakland. Trapped in snow up to their chest. Affecting hundreds of thousands of commuters and its in the name of safety. Washington, dc, 700,000 commuters use the metro every weekday but they cannot today. There was a higher in the subway tunnel on monday that may have been caused by a problem with wiring. Metro officials are checking the entire system, making sure there are no other wiring problems. You will see that traffic is backed up. Slightly later than usual. This week is spring break for some and that means that traffic may be lighter. Lets look at the south bay.
