Police say riley started firing at them sunday morning on tully road. Police shot back, but did not hit him. Riley was later arrested at a Mobile Home Park in the area. This was the third officer involved shooting in the last week. mark if you drive in the north bay you could soon be charged a toll to use highway 37. Officials say the highway is prone to flooding and Traffic Congestion and charging a toll could help fix some of those problems. Marin county officials it can take years to get the money to fix the highway and a toll could help speed up the process. But some Business Owners in the area say a toll will be too costly for them. mark fortythousand people use highway 37 every day. The lawsuit claims that personal bankers and managers turned to unethical and potentially illegal ways to reach their daily sales quotas. His past offenses include indecent exposure, child molestation, attempted lewd acts on a child under 14 and assault with intent to commit rape. Lee was arrested outside a class monday morning and he had been attending classes for nearly a semester. But yeah like i said it helps. What would you like to say to this jury . Just they made the right decision. They based it on the facts and yeah. Did a great job. What would you like to see next as far as the penalty phase. Im not going to comment on that right notch. Because thats still pending. So but yeah we are thinking positive and we hope for a good turn out there. Just pretty much the same thing they said. Well obviously never get sierra back so its not closure but it is a good first step and the jury did the right thing. Thank you. Thank you. And you are hearing from the lamar family, five years two months since the disappearance of segura. And the conviction of the man who the jury just decided killed her but without a body they continue to search as soon as this weekend. Weve got a legal analyst here with james and as we look at some of the activity outside of the courtroom and we heard from the family and how desperately they still want to find sierras body what could happen next out of this and would he, Garcia Torres, ever help with locating the body. Thats the big question. We heard that from searchers. The family has wondered that as well. Now that we are past the conviction stage is there any motivation for Garcia Torres to give up the location of the body. They are going to keep searching until they find it. From a legal standpoint is that a possibility in this stage of the proceeding. Its a possibility. Its a bargainingship he could use to gain lean frequency. Its illadvised. How so . He maintained his innocence throughout the trial and to do a 180degree turn theres no guaranty but it may slid phi the Death Penalty. He also has a series of appeals in front of him so if he has any hope of getting out and this is a case where the opportunity and probability of success are a lot higher than other cases because of the way the prosecution put this case together then hell go to prison and whether hes on death row or not hell always want help to get out and giving up the body will not get him out any sooner. We want to go back out live in front of the courthouse. Whats happening now . Joining me now is marlene lamar. You were just at the podium. Let me ask you a little bit more questions. Your moments before the verdict feelings, there must have been knots in your stomach. There were. I was pretty confident. I feel the da did an excellent job, david boyd has been so supportive and taken us through the process and made it easy for the entire family to be prepared for anything. And honestly you cant be prepared for Something Like that before the verdict is announced. And we are just grateful and blessed that the jury came up with the verdict that they did. And its going to be a safer world because of them. It is on their conscience and i was just praying that they would remember that. You were making a comment at least no child will be harmed by him again. Yes and the streets are going to be safer. That gives us some peace. It doesnt give us closure but knowing this is not going to happen to another young child is definitely part of the healing process. When you speak a lot about your faith and god, what role did your faith play in helping you through all of this . Well if they didnt reach the verdict that i was praying for i knew that justice would happen no matter what. That we would surrender to god and pray that justice will happen in a different way. When you heard the g there was a lot of sighs and emotion in the court from the family and sierras friends. It was like they were releasing their pain when that was announced. Ive seen cases where people need to be held up when the jurors went g a few people would have collapsed if they were standing. It was that emotional. Any release from you . Any kind of sigh . It was definitely something thati was over come by the its been a journey. Its been very difficult and the angst its like reliving the nightmare going through the trial but much worse with the gory details that you have to hear. Its something i am grateful that another parent will never have to go through. They kept saying she was a run away. For this case to happen prosecutors have to say she was not a run away. That she was dead. Was that hard to hear them hit that angle . Thats right. Well there were a lot of witnesses, sierras friends and family members. Im pretty sure that the presence of all of us showed our commitment and love to sierra lamar. And that she will not be forgotten. This is five years later and her friends have been there for her this entire time. You know how sometimes High School Friends drift . Well thats not the case so if shes up there she knows that and that gives me peace knowing that shes gotten the communitys support, familys support and her friends have been consistently there for her. How do you cope . Faith. I tell you, im surviving because of the faith that i have. When we found out that the verdict was going to be read at 9 00 this morning there was so much anxiety on my part i would imagine i barely slept. You probably didnt sleep a wink. I barely slept. Theres no guaranty until its announced. What did you think about when it was a sleepless night what did you think about . Im thinking please god let the verdict be just. Let justice prevail. I just surrender through you and just hope that the truth comes out. He seemed a cool customer today. Did that bother you at all . I wasnt able to see his face but i wish i could have. What sort of things went through your mind. Tell us your range of emotions whatever flashed through your mind when you heard guilty. Im just thinking this is a horrible horrific thing a parent should ever have to go through and im so grateful and blessed that the verdict came out the way it was. Truthfully i was with all of the evidence the dna the fingerprints that if that wasnt even a people wouldnt depend on the judicial system when you think about it and there would be more crime and a lot of children that would be victimized if this court set precedence for both the community and safety and for the people of our criminals as well. You leave here completely satisfied . What more in your mind needs to happen for you to beto say that justice was fully served . This was the start. This was the first milestone. This was the first step and it was the right thing to happen. What else for you though . What else do you need or want . Right now i cant look that far ahead. Im just grateful for what i heard today. Thats all i can handle right now. Is that important for you . I have no comment about that right now. Are you glad to hear that hes at least eligible for that punishment . Im glad to hear that there is a great possibility he will never be released and do this to another person, another child. Are you blown awayive covered this case from that weekend that sierra disappeared on a friday and we started covering this on a saturday. The days, the weeks, thousands of volunteers who never met sierra showed up. You remember at the morgan hill search center. Five years later we talked to one of the volunteers and came out and was in tears. Are you blown away by the overwhelming love for your daughter . Well the community has definitely stepped it up and i just hope that this never happens again but there is hope for people. And i dont want this to ever happen to another parent but there are people out there that care. Your child matters in this world and thats whats important. Why do you think it made such a connection with this community. This is something weve seen before. This volunteers for this long. Because this type of thing has been happening a lot on the news in the last ten years. Ive been following every case and the way it happens, walking to a bus stop and they have this special uber now that picks up kids, they have life 360, find my friends. People are becoming more aware that this is not really a safe world anymore. Thank you so much. Marlene lamar giving us an indepth interview. There will never be closure. She could not comment on whether or not she believes in the Death Penalty, whether Garcia Torres should receive the Death Penalty. Prosecutors should not go into that as well. We do expect an appeals process. At least this is one step of the journey. In her words at least no other child will be harmed by this man. Back to you. Thank you. We continue to cover the guilty verdict in the kidnapping and murder of sierra lamar. And its not unprecedent but rare that there is a murder conviction without a body. Weve got a legal expert talking to James Fletcher about just that. We pose the question to you. Doesnt seem like we can draw many memories of a case thats gone this far where the suspect has been convicted in a case where there is no body and you were saying yeah that actually is pretty rare. Its extremely rare. The defense only found three instances where its happened in the past. I believe that was federally but i cant recall if that was just california. I think it was federally. They had to go pretty far back to find these cases. One in the 50s, one in the 70s they all involve different facts than were present here like a motive, blood stains, things like that. This is definitely an extension of what it takes to convict somebody without a body. Okay so we heard comments from sierra lamars mother and other family members and searchers talking about the first good step in their mind in getting closure. The penalty phase is coming up next. Walk us through Going Forward what are the steps. What happens in the next phase . The penalty phase will be another trial essentially. The jury will be there. The prosecution will put on witnesses. Theyll put on witnesses for the prior kidnappings that were alleged, maybe other incidents where its a lot broader than it was in the guilt phase. So they can put on for example maybe an exgirlfriend who said he was violent, things like that. Sure. Theyll put on essentially their case again in a way directed at showing that hes just morally corrupted. And the defense of course will try to do the opposite, paint him as a victim of circumstance and that other exterior factors led him to this moment in life. Lets say the penalty phase finishes. There are appeals down the road. Once he isonce the penalty is delivered what happens . He goes off to prison. And his defense team moves on with what an appeal right away . It will either be his team or another team likely paid for by the state of california who will make pretty decent amount of money to continue his appeals for the rest of his life whether he is put to death or dies of natural causes. It will probably be the latter. Now you were saying while we were talking off air there is the possibility of an appeal which in all likelihood is what will happen but they may try to retry it all over again. Its common. We did it in a case where we file a new trial motion before sentencing to try to bring out issues in the record which are so appealable that maybe the Trial Court Judge would want to give them at this point save the taxpayers money, save the family and everybody a lot of anger because as relieved as everybody seems to be with the fact theres a verdict and closure times by a thousand when it gets over turned on appeal. Right and you say that process may happen before the it has to be done before the penalty phase . Theres several opportunities but this is a Good Opportunity now to file that. Wow. So we saw the attorneys come out, we heard from the prosecutors. The Defense Attorneys didnt come to the podium at all. What do you think was happening with them and their client in the room and the fact they didnt want to speak to the media they just left. Is that typical . M my opinion its unfortunately typical. Its important for a client that the attorney be their voice and they dont have an opportunity to speak to the public like their attorney would and i think its unfortunate that the attorneys didnt come out and advocate for some aspects of the case that was unfair because there are obviously aspects that were unfair from a legal standpoint and defense attorney standpoint. However they went through three months of trial they are emotionally exhausted, heart broke and let their client down. Its not the best time to face the public especially in a case like this where the public is overwhelmingly anti mr. Torres so maybe they werent up to it. Going forward between now and when the penalty phase begins i guess his Defense Attorneys will meet with minimum start lining up their witnesses and the prosecution will do the same thing is that whats going to happen between now and when the penalty phase starts . Thats correct. Id be surprised if the penalty phase resumes in three weeks. It will be a month to two months at the soonest. Good enough thank you.
