Judges should not be politicians. Neil welcome to washington. This is how it is likely to go down. Lindsey graham says they will likely go along party lines, that all republicans will vote for her. Can it all be done by election day . He says yes, and then some. Welcome to your world, everybody. Im neil cavuto. What a crazy day. We knew their positions. If you are a democrat, you dont like the idea that this is even going on right now. If youre a republican, you want to move fast just in case right now, so where do we stand on this . It was an opening day of everyone kind of stating their positions, including judge judge barrett, but it is going to start getting nasty. Doesnt Shannon Bream know it. A legal eagle unlike anyone i know. What happened today . Shannon, go ahead. Well, neil, great to see you. It was the opening day, all of the senators staking out their positions. The lines of attack that the democrats will try to use with judge barrett. She sat there silently until the very end of the day, giving her side of the story. One of the things that they are doing is attacking the process, called a sham. Unconstitutional. Also going after key issues they know voters care care about, which includes the Affordable Care act, so today, senator blumenthal was among those who warned america that if judge barrett becomes just a spirit, obamacare is in trouble. Heres what he said. But now, just one week after the election, the fates of the Affordable Care act will be again in the hands of the United States Supreme Court. Republicans have turned again to the court to try to achieve judicially what they cannot achieve legislatively. Well, as senator dick durbin was even more direct. He said basically that president is sending you to the high court to kill this. They really know about how these other justices think and how they are likely to vote, think it is very unlikely that is actually what is going to happen. Resonating with voters and with viewers because that is such a big issue. Now, judge barrett, she talked about acknowledging Justice Ginsburg and said i can never replace her, but i can follow her, as a wife and a mother and a jurist. And of course, the highest praise for the man, just as anthony scalia. She will follow him. Here is her talking about him. His judicial philosophy was straightforward. A judge must apply the law as it is written, not as they wish that it were. All right, so, neil, it is all out there. Everybody is ready tomorrow morning, 9 00 a. M. Judge barrett says today that she has heard from a lot of people around the country. She says i believe in the power of prayer, and starting tomorrow, probably everybody in that room is going to need a little bit of that, neil. Neil how are kids doing with this . How did that go . You know, they were there. Sometimes they werent in the room, but they came in, and they almost look like they were headed to church. Perfectly addressed. The girls in dresses. She talked about each of them, and it was really touching to hear her lay out their personalities and what they are all good at and what they are loved for and known for within the family. Its a good moment for her to personalize herself before the attack start here the kids seemed very well behaved, but they were not there the whole time, neil. Neil yeah, wouldnt be like my kids. I will just leave it at that. Thank you very, very much for that. In the meantime, lets go to judge Amy Coney Barrett back in 2007. Youve known her well, and thank you for coming. You know, i dont believe we have ever had in recent memory a justice with young schoolaged kids. Now there will be plenty, if she makes it. That was the first thing she talked about. Yeah. Thank you for having me on. Judge barrett would be the First Supreme Court justice with schoolage children, and i think that will absolutely she is open about how important her family is to her, and we would see her children, be there while we work, and i think that dynamic will be the same. Neil you know, for her Circuit Court of appeals nomination process, the religion and dogma questioning, how did she hold up . I know that you joined her. And im just wondering how she obviously knows what shes in for. She knows that there will be attack lines, probably has memorized them. How do you think she holds up . Well, i think that the process is brutal, no matter who the nominee is, but judge barrett has excellent composure. Her confirmation hearing, just evidence of that. She was courageous the entire time. And i think we will see that same composure over the next week, even though the questioning and the battering may be bad. Neil as far as that timeline, has she ever said yeah, i guess we can get this done before election day . She is aggressive, but does she have any worries that you know of . Not that i know of. I think judge barrett is so focused on mobile and not on politics, her dream is to be the best that she can be. Neil yeah, i have a feeling you are right about that. Thank you very much. She clerked with the judge. Former independent counsel. All things constitutional or n not. So, talking to you again, you know, this process can be very unseemly, and over the years, even more so. Ruth bader ginsburg, not that long ago, but of course, times have changed. How do you think this process is going to go . The chairman of the committee, Lindsey Graham, very confident that the votes are all there. It will be wrapped up before election day. What do you think . It appears that way. Its going to be ugly, but its going to be ugly in a different way. We hope and frank, speaking of prayer, justice kavanaugh, think back. Lets face it. They have the income, as it was put many years ago, a mess. How big of a mess is it going to be . Not the kind of ad hominem attacks on the individuals character that we have seen, including with bob, so many years ago, but it has really become very political. You are being put on the court, judge barrett, simply to overturn the Affordable Care a act. That is nonsense. Absolute nonsense, but it is politics. It is the political season, and frankly, i think that this is all the democrats have. They dont have substantive arguments with respect to her qualifications or abilities, or character. Look at those kids. She drives a minivan, right . With seven children. And the outpouring to your her former dean, as Lindsey Graham said, the dean was so powerful. I am here with the equal kind of confidence in character of this judge. Neil and i always, myself, is mine in High School First of all, doesnt ring a bell. The name doesnt ring a bell. I was thinking of you. A new profile on merrick garland. Of course, he was Barack Obamas pick, the final year in office. We all know what happened, but it talked about how his profile has driven dominic risen rather dramatically. The point that got me near the end of the article was that he is unlikely to be called to become a Supreme Court justice, no matter who is in the white house. A hearing on the side of young. Two things that i took away from that. I will never be a Supreme Court justice and it is a Young Persons world. I guess they want people to be there for a generation, right . Right. Ronald reagan change the whole dynamic. The whole culture. Ronald reagan, one of our worlds president , said lets go with the youth factor. So, he wanted what President Trump has done, to appoint individuals, and now here is Amy Coney Barrett, and early 40s, who will be able to serve on the federal judiciary for an entire generation. That is such an important legacy appoint a president. Ronald reagan was the first to see that, but now everyone has gotten the picture. Neil yeah, these young kids today. I dont know. Won in 1936. He was annoyed as all heck because a lot of the justices ruled it down a lot of the things he wanted to do, so he said i am going to pack this puppy and try to add judges that will make it impossible for them to overrule me. Here is the thing that happen. Not only did republicans find it obnoxious but democrats did as well. He learned his lesson. Now, fastforward to today. What is joe bidens view on all of this . In toledo, joe biden only made a single mention of the Supreme Court confirmation hearings underway right now, and even then, you mostly steer the focus away from judge barrett herself, saying this nomination is about v5s crusade to eliminate his predecessors health care plans. Why are republicans going with a hearing on the Supreme Court, providing a significant economic deed to her i will tell you why. It is about finally getting his wish to wipe out the Affordable Health care act. Republicans want to seize on any democratic because it breaks the American Standard of not judging folks based on religion. Democrats did criticize her on her face during her Appellate Court hearing, and the Trump Campaign has already made attack outside of it. Cautioning against a repeat. During a hearing now, they should not be considered. None. I dont think there is any question about her face. Biden has not been so direct about whether he would back the courts if she is confirmed, saying he will answer after the election. Biden says President Trump wants his hypothetical future actions to be the focus instead of what they are doing right now, with voting already underway. Trying to frame this as unconstitutional, saying voters are being robbed of their chance to weigh in on the process because voters are the makeup of the next senate, and he has repeatedly shifted the focus off of him and back to the other party. Its been a while, so thank you for joining me. This process, you know that the democrats say, you know, its a sham. It shouldnt be happening. And thats not right. One of the things that theyve been kicking around is this idea, if we get this out of, we are going to pack the court. Of course, joe biden and Kamala Harris havent said anything and dont want to tip their hand, but do you think that would happen if they won . That they would do that . Well, you know, the concern is that what is popular political sound bites can become a movement if you round on the issue and voters expect you to deliver, and various democratic members, and Kamala Harris, herself, suggested that this was a real option. And it is a curious way to honor the legacy of Ruth Bader Ginsburg because she spoke vehemently against this type of proposal. She said it would effectively destroy the court. And it would, you know, for almost 30 years, i have proposed the expansion of the Supreme Court, but that is over the course of about 20 years. That is different from packing the court. Just to dump five or six new members so you get an instant majority. That would do considerable violence to this institution. It would destroy any semblance of credibility, which is what ginsberg was referencing when she opposed to this idea. Neil you now, it has been nine for a while. The better part of a century, but i know that there wasnt any magic to that number. There have been fewer. There have been more, but we have gotten used to this. What is the upside of this nine . It is an accidental number. We never had a great debate in this country as to the ideal size of the Supreme Court, and of course, the constitution does not set it. We have had a smaller court and a large record. I actually believe that we should have a larger court, but not like this. There is a difference between reforming and packing the court. What is suggested today at, that is what is troubling about joe bennetts position. You know, this proposal is suggesting that it will destroy one of the key institutions of our constitutional systems, and yet biden is saying that the voters will know his position after they vote. Well, you know, these are not supposed to be blind elections. On an issue of this importance, which was raised, by the way, by the democrats, not by the republicans, he really does have a duty to be clear. A lot of americans will not vote for a candidate who would even consider a Court Packing plan. Neil do you think that the given i guess what im trying to but they would be open to that if they got in there . If they were to get a senate majority. I know that these are both big leaps, that they would pursue this . Well, im always optimistic that there are mature mines that will come in. After the election, a lot of the overheated rhetoric tends to dissipate. We have already seen that in the Biden Campaign where he has stepped back from a sort of position on the father left to you more of a centrist position, so im hoping that that would be the case, but this is an age of rage. We have no idea what it is going to be like after the election and who is going to be in congress, but the important thing is this is an idea that should be an upfront mind of all americans, regardless of party affiliation, and every candidate should be able to answer this question. It says something about their view of the constitution. It also says whether they are willing to put principle that of politics. Neil yeah, very good catching up with you. Then after that, hes got another rally in pennsylvania. Carolina on thursday. Four rallies in four days. Mike pence spent the day campaigning in ohio. Now, he did talk about the confirmation hearing that was happening at the same time, and even out democratic senator Dianne Feinstein did not repeat her now famous line to judge barrett today, the Vice President make sure that voters did not forget it. Ive got news for the democrats. And their friends in hollywood. That dogma lives loudly in me. That dogma lives loudly in you, and the right to live, to work it, to worship according to our faith and conscious lives in the constitution of the United States of america. These attacks on religious faith must stop, and they must stop now. Now while President Trump was sidelined, the Vice President took up a bit more spotlight than usual, but expect that to change. It could get nasty. Other folks with a certain decorum, it has kind of been lost over the last few nomination hearings. How do you think this one is going to go, senator . Well, it is going to go good from this standpoint. I think that the democrats realize how qualified this person is, and they cant in any way attack or there, so you heard a whole day of democrats, every one of them, distracting and distorting because this nominee is so very wellqualified to be on. And i think its going to not be as bad as brett kavanaugh, but they are going to get into the weeds and scare every voter in america, that your Health Insurance is going to be taken away from you on november 10th. I think biden so that today. A week after the election, they are going to have this case brought up. He is a lawyer. He ought to know better than to lie to the American People that this case wont be made public maybe four months down the road, and a lot of times, they dont do it until the last couple weeks of june, so to lie to the American People and say on november 10th, your insurance is going to be taken away from you, we just cant let that stand, and tomorrow, we are going to have to, as republicans not only question her about the things we want to know about her and how she might handle certain cases, but we are going to have to use a lot of our time to keep them from lying about her. We will see if youre one of the first issues the court would be taking up, a key provision of the Affordable Care act that gets back to funding and all of that, but the problem for republicans, as you know, you never came up with an alternative plan of your own. You missed it by one vote when john mccain famously didnt move the ball forward. So the republicans are on defense on this issue. Are you concerned that just as it helped democrats win the house a couple years ago, it is going to help them even more n now . Now, because there are so many issues in this campaign so much bigger than that. And one of them is dealing with what we are talking about today. Biden not willing to tell people does he want to pack the court . And i am me and where it has been for 150 years . He says just like they did on obamacare. He remembered pelosi said we have to pass it to find out what is in it. You have to elect biden to find out what hes going to do about packing the court and change the constitution very dramatically but dramatically by making the Supreme Court what they want to be a super legislator as opposed to doing what the Supreme Court is supposed to do, interpret law, not make law. Things are at an impasse right now. Where should americans think this is going to be added for them . The good news is secretary mnuchin and Speaker Pelosi are still having communications. They are still talking. I think both of them recognize, as the three previous chairs of the fed, jay powell, ben bernanke, both have said, this is something we have to do quickly, and we ought to go big. So, i think there was something encouraging that the president did. Not sure what it means because he says one thing one day, and then he changes, but he saying now we need to go big as well. But that was followed by him saying that we need to do continuing talks until after the election, but it is not democrats americans republicans, democrats, independent ofs, vegetarians, Oakland Raiders fans, i mean, everybody. Weve got to have something. I just got out of it as a meeting bankers, and they are saying weve got to have a spending bill, or it is going to do enormous damage and take us much longer to get out of the hole. The president still has to do some convincing on his own partys side. You have a numbe number of repus who are still frustrated by what the president has brought up, and we also have over the weekend the white house chief of staff, the treasury secretary saying we are calling on congress. Lets get this done. Lets do that. However, nothing has moved yet, and i know that the airways today has been filled with the Supreme Court nomination, however, this is something americans are waiting on every day, hour by hour. What is going to move this along . Well, i agree with everything you just said. I think most americans agree with what you just said, and i hope they also agree with the fact that we need a holistic approach to this. We can start crossing out pieces, you know, because that is going to do damage to lets take the airlines. Then we will take care of the payroll protection program. We have to do everything. We have to do it as quickly as we can. To the american public, i saying it is here. We can pass the bill. Its what the president wants, but it will mean that republicans and democrats will have to vote together. Particularly in the house, more democrats voting then republicans, and i think that it is a political picture that some republicans dont care to share. That may be the only way we are going to get something substantial passed, and you know, i would rather have both sides been doing as opposed to breaking the heart of the american public. I think that is what is going on. People are hurting and crying. Members of congress not even involved in the negotiations, but i think everybody on both sides of the aisle should express their position. We need to get something done quickly. I would like to get your thoughts on how you thought things went. We are just at the beginning of the week for judge Amy Coney Barrett. How do you feel democrats are doing right now and then his hearing, and are they walking a fine line this week . Theyve got to be careful. She seems to be doing well. I havent watched most of this, but there are those who are attacking her, attacking her religion, which i havent heard. My colleagues if i hear somebody attacking her religion, i will condemn it. Three years of seminary i respect every religion, every faith tradition. And if someone is attacking her religion, that is in fact, i just made a phone call. I keep hearing republican saying that. Could somebody tell me who it was . And i want to try to figure that out. Congressman, we really appreciate your time. And it was the opening some say the continuing terror war that continues to this day. The commander of the uss cole joins us right now. Very good to have you. Thinking about what you and your men endured that day, and would trigger more than 11 months later, countless attacks back and forth sounds, what do you think . Well, neil, it was one of those where the attack on uss cole really was the start, because whether it had been World Trade Center one, the embassies in africa, there were attacks by terrorist organizations against buildings that housed and represented u. S. Interest, the attack on uss cole was an attempt to prevent us from defending those interest, and when you try to take away a nations ability to defend itself, it is an act of war, that because of the mindsets of the American People in the Political Class at the time, they missed it, so unfortunately, we suffer through 9 11 11 months later. Neil was there any you see these guys coming up, looks like a motorized that they wish to harm . Anything tip you off . There was no indication. That morning that we pulled in for a brief stop for fuel, as part of routine harbor operations, three garbage barges to take out trash, and two boats came out. Went to the middle, went to the back by the flight deck. They left halfway across the harbor when a boat that looked exactly like they did, about 24foot long, with two people in it, came right to the middle of the ship. That is how it was inside the security perimeter, and detonated an explosive device, which the navy had no intelligence on. We had never trained for it, and consequently, that explosion would kill 17 and one to 30, but the crew responded as true heroes valiantly, and immediately went out to save that ship and their shipmates. Neil just amazing. That was an al qaeda sourced attack. Al qaeda, others from the taliban, to isis have emerged. Different names. Same perversions. We like to say now weve got isis on the run, and this is a problem anymore. You have always reminded me, they are like cockroaches. They come up in different forms, different locales. Are you still worried about that . Im very much concerned. Unlike the mindset back then, i think americans now realize there is no such thing as a nonstate sponsor of terrorism. All these International Terrorist organizations have state sponsors somewhere that allow them to recruit, to conduct operations, to do financing, get arms, so consequently, its going back to some of these governments that have supported it.
