names. This one really got to the heart of the management of the Justice Department. The president also said what kind of man is this . This is, of course, one of his strongest supporters. This is possibly one of the most consequential Attorney Generals that we have had in a long time. He helped push through some of the president s big agenda items. That is the great irony that they are in such a bad place. And sessions directly responded to the president. The president said he hadnt taken control of the Justice Department. The Attorney General said i took control of the department of justice the day i was sworn in. So there you have it right there. What would happen if the president were to Fire Sessions . How would it impact the russia probe . If he got rid of sessions this would be the most direct way for the president to put someone in charge who would be able to oversee the Mueller Investigation. Perhaps that is what is on his mind. Of course, that would bring all kinds of political problems
which is why i think a lot of people have advised him to not do this. At least dont do this before the mid terms. Politically it would be a very bad thing for even republicans. His legal team has been telling him that. It would also raise questions about obstruction. This is something that has been brought up and questions that Robert Mueller has asked of the president s legal team whether his criticism of sessions is part of this picture of the president trying to obstruct this ongoing investigation. If the president were to Fire Sessions or if sessions were to resign. Rod rosenstein would be acting Attorney General until a new Attorney General is sworn in. The president is not a fan of Rod Rosenstein. Phil, what are you hearing from lawmakers . Well, i think that Attorney General has to protect the Russia Investigation except that you remember he recused himself because of his meeting during
the campaign with the russian ambassador. Thats why he had to recuse himself. Rod rosenstein has made clear this investigation must continue. What we have learned again, wolf, what was reconfirmed for us this week in the convictions of Paul Manafort and guilty plea of the president s personal lawyer is that this is no witch hunt. This is a serious effort to get at the truth of what happened in the last election. And now the implications for the violation of law by the president need to be pursued, as well. As you know, the president has been implicated by his former attorney in a felony. If democrats were to win back the house following the Mid Term Elections in november do you think you have enough information right now to begin Impeachment Proceedings . I dont know why this needs to wait until after the election for the house to take action. The president because of what we learned this week, the president is an unindicted coconspirator confirmed tin the interview a dy after the assertion is made. The republican majority ought to start the process of gathering information, bringing in Michael Cohen, speaking to the prosecutors in his case, bringing in the president s chief Financial Officer from his business who apparently knows a great deal about this. That is the job that the Judiciary Committee is supposed to do. A year ago i asked my colleagues where do you think this is going and why arent you interested in getting to the truth. Here we are a year later. So much more information has come out that is so damning. This is about defending the constitution. I dont know that there is a single republican on the committee or in congress who is willing to stand up for the truth anymore. Its frightening and it is sad, but the American People expect members of congress to stand with them and defend the constitution, not just to defend the president. The other is that Jeff Sessions as this statement may indicate today, the strongest pushback we have seen from sessions to date, that he sees himself with a responsibility to protect the institution of the department of justice and to protect no Political Considerations interfering with justice in an inappropriate way and perhaps that is why he stays. You heard senator Lindsey Graham say there should be serious discussions about removing sessions after the Mid Term Elections. That is quite different than what he said in july. There will be holy hell to play. Any effort to go after mueller could be the beginning of the end of the Trump Presidency unless mueller did something wrong. That was july of last year when he had a different may of this year Rudy Giuliani told dana bash that mueller would not be sessions would not be removed until the Mueller Probe was over. These are arbitrary deadlines. I think it is very important. This person, the Attorney General serves as Donald Trumps pleasure. Why does it make a difference if it is after the election. I get the Mueller Probe somewhat. Sessions is recused from the Mueller Probe. The other point i would make is donald trump doesnt understand that yes he nominated, appointed
Jeff Sessions. Jeff sessions isnt his employee, per se. Jeff sessions responsibility at the end of the day is the Justice Department. Donald trump views things as he is disloyal to me. A quote he gave last july, he said this is a very bad thing Jeff Sessions did to the president. He has no understanding of why Jeff Sessions did it which is he thought he was too close to it. He did not acknowledge the fact that he had a couple of meetings. He took the recommendation of professional Career Officials that look at recusal and say you should advise. Firing Jeff Sessions has the effect of firing Rod Rosenstein who is only taking over the Russia Investigation because sessions cant do it. If he does Fire Sessions would he get pushback or support from republican lawmakers . I think if it is before the election there would be some pushback. You probably wouldnt get that person confirmed. Today we were hearing from people that perhaps after the election this could happen. That is also a gamble. Who knows if they will keep the senate . David pecker who runs the Parent Company of the national enquirer, we have learned that he has been granted immunity in
exchange for his testimony before the federal prosecutors. In case david pecker were to be hit by a bus. The presumption has been that Karen Mcdugal all of those things can come to pass. I would never have granted or asked for immunity from the department of justice to give Somebody Immunity unless they had information i couldnt get anywhere else or corroborated someones testimony who is less credible or you were at risk of being prosecuted by me for your own involvement in the case. All of those things appear to be true. Yet again you have Andrew Wisalburg subpoenaed. The walls have closed in officially. If i were the president the chief Financial Officer for the Trump Organization after the last year or two, for 40 years who knows presumably so much about what is going on there. You is to worry about david pecker. Can you imagine if he gets into some sort of trouble how President Trump will try to distance himself from something . These are people who understand the Inner Workings of Donald Trumps world for a very long time. That is a threat to the president. He has been subpoenaed to testify before the federal prosecutors. I think one of the under played elements of that interview with fox today is his
attempt to distance himself from Michael Cohen. I knew him on and off. The guy who we know was in charge of setting up the Shell Company that he testified was directed to do so by donald trump to pay off two many making allegations about affairs in the run up to the 2016 election, that is not a guy that you are kind of acquaintances with. That is the most touching personal and professional thing you can deal with. Its literally factually impossible to say that Michael Cohen and he are not close. Why did a lone juror in the trial of Paul Manafort refuse to convict on ten of the 18 counts . Balance. Tonight a juror in Paul Manaforts fraud trial says the note was passed because one juror was holding out. The person, a female juror we all tried to convince her to look at the paper trail. We laid it out in front of her again and again. She still said she had a reasonable doubt. We did not want it to be hung so we tried an extended period of time to convince her and in the end, she held out and thats why we had ten counts and did not get a verdict. Thats confirmed by just a release of a copy of the jurys form saying 11 guilty. Manafort was convicted on eight. That one hold out juror had a massive impact and not just on
this case against manafort. If hes convicted on 18 counts, that changes the entire landscape of everything. One, it comes close in tripling the amount of time he could be spending in jail and that implicates issues as to whether hell be called down the road as a witness of potential impeach. One day if that ever comes to bear. Reporter the weight of the case caused enormous strain in the room. Juror duncan. One of the females that did change her vote to guilty would come in one day and say guilty and the next day said , oh know i felt pressured. It is a fascinating phenomena. Sometimes you are in the
courtroom during deliberations, you can hear yelling and screaming in the jurys room. They did not think gates was credible. Duncan says she did not want manafort to be guilty but she voted to convict on all 18 counts because the evidence was overwhelming. Manaforts defense team never called a single witness. All of that speaks to how strong Robert Muellers case against manafort was. Their star witness was the documents and bank records and emails and text messages. Thats the fundamental Building Blocks of this. Thats what they were hammering. We are also learning new details on how close this judge came to declaring a mistrial in the manaforts case. Newly unsealed Court Transcripts say one juror commented that
manaforts defense was weak. Jurors are not allowed to discuss the case among themselves until deliberations officially began. Manaforts lawyer pounced on that. They pressure the judge to declare a mistrial. Judge ellis did not do the thing but did have to delay the trial while he interviewed the juror errors one by one to make sure they are not bias and it did delay the case. Very interesting, wolf. She did not have in comments of the prosecutors. Paula duncan says, at time she thought prosecution were bored. She saw two of them napping during the trial.
