Welcome to our viewers in the United States and all around the world. This is new day. Its thursday, july 9th, 6 00 here in new york. Coronavirus cases hovering around record highs in the United States. We saw Record Numbers of deaths or near records in california and texas. And overnight, dr. Anthony fauci said states seeing the biggest spikes should seriously consider shutting down. This is not what the president wants to hear and it seems he might even be trying to prevent it from being said at all. Dr. Fauci was sidelined for a Coronavirus Task force briefing. The president is openly clashing with the countrys top medical minds, with the help of millions of children, teachers, and families on the line. Hes now threatening to withhold money from schools if they dont reopen and demanding the cdc rewrite its sciencebased guidelines for reopening schools, because those guidelines are too tough. There are more than 3 million confirmed cases of coronavirus nationwide. This morning, 33 states are seeing spikes in cases. Only three states this morning are declining. In order to reopen, that number is supposed to be 50. Some of the hardesthit states are reporting alarming Positivity Rates. And hospitalizations in california are up 44 in two weeks. Health care workers across the country are again facing those shortages in protective gear like masks, gloves, and gowns. Lets begin our coverage with cnns rosa flores. She is live at a testing site in miami. What are you seeing, rosa . Reporter alisyn, good morning. Well, 33 states are showing upward trends this morning. In texas, wednesday. 98 people died. That is a record for the lone star state. In california, one of the first states to impose restrictions is now seeing the situation worsen there with both infection and hospitalization rates increasing. Hospitalizations also an issue in arizona. Er visits are hitting about 2,000. Now, the recommendation from dr. Fauci is very simple. For those states having issues, shut down. I think any state that is having a serious problem, that state should seriously look at shutting down. Its not for me to see, because each state is different. New york did what, you know, i was in multiple conversations with Governor Cuomo and with nairm de blasio. And those are the things that we discussed. They did it and it worked. It worked for them. Reporter now, the Positivity Rates in three states are alarming. Take a look. In the state of arizona, 28 . In texas, 26 . In florida, 19 . Heres the reality here in the state of florida. Just yesterday, 10,000 new cases were reported here in Miamidade County where i am. The Positivity Rate is 28 . Thats an increase from yesterday from 27 . When it comes to hospitalizations in the past 13 days, theyre up 70 . Icu units, 84 . And ventilators, 116 . Despite all of that information, the state of florida is requiring schools to reopen with inperson instruction in the fall. Now, we checked with two superintendents yesterday, both here in miamidade and in broward counties, and they say that so long as these two counties are in phase i, they are not going to reopen for inperson instruction. Now, alisyn, yesterday, in palm beach, the School Board Members there had a meeting, theyre talking about virtual schools, according to the superintendents twitter, theyre going to make a decision on july 15th. Alisyn . And rosa, well be talking to one of those School Superintendents later in the program, so people should stick around for that. Thank you very much. President trump is demanding that Public Schools reopen next month, despite the surge in cases in most of these states, across the country. If they refuse, he is threatening to cut their funding. Cnns joe johns is live at the white house with more. What do we know, joe . Good morning, alisyn. As the president continues to push for the United States to reopen, we have more staggering numbers to report this morning. 58,601 new cases. And as the pandemic situation worsens in some states, the white house Coronavirus Task force announcing that it will fall in line with the president s demands for it to relax its recommendations on the safe reopening of schools. President trumps push to reopen schools is going against the advice of some of his own Top Health Officials and as coronavirus cases surge in at least 33 states. Were finding out that learning by computer is not as good as learning in the classroom. We want to learn in the classroom, so our schools we want them open in the fall. Reporter the president complained about the cdcs guidance on a safe return to inperson learning this fall in a tweet, writing, theyre very tough and expensive, and theyre asking schools to do very impractical things. Hours later, the Vice President made this announcement. The president said today, we just dont want the guidance to be too tough. And thats the reason why next week, the cdc is going to be issuing a new set of tools. Reporter some of the cdcs current suggestions include wearing face coverings, keeping desks 6 feet apart in classes, and closing communal spaces, like playgrounds and lunchrooms. Trump comparing the u. S. To European Countries that are allowing schools to open, like germany, denmark, norway, and sweden, ignoring the recent record highs in new cases here while those countries continue to see lows. Cdc director dr. Robert redfield both defending and downplaying his own guidelines. We want to make it very clear that what is not the intent of cdcs guidelines is to be used as a rational to keep schools closed. Remember, its guidance, its not requirements. Reporter pence also making this claim. Were actually seeing early indications of a percent of positive testing flattening in arizona and florida and texas. Reporter but the Positivity Rates of all three states have been steadily increasing since june and are currently well above 10 . Even with pressure from the white house, statement leaders say theyll only open schools when its safe to do so. Im not sending kids and our Education Workforce into our schools unless its safe. Its that simple. Were listening to scientists. Not threats, not politicians. Reporter meantime, dr. Anthony fauci telling the wall street journal that Public Health and Economic Freedom dont have to be at odds. We shouldnt think of it as one against the other. Because once you start thinking theres Public Health and then theres the economy opening, it looks like theyre opposing forces. So what were trying to do is to get the Public Health message, if heard and implemented, be actually a gateway to facilitate opening in an easier way. Dr. Anthony fauci attended the Task Force Meeting on wednesday remotely. He did not attend the briefing that followed. He and the president have been at odds over the messaging in the pandemic. The president himself has not attended one of those meetings since april. Alisyn, back to you. And optically, seeing dr. Fauci sidelined in that way begs some questions. Ali khan, hes the dean of the college of Public Health at the university of Nebraska Medical Center and the former director of the office of Public Health preparedness and response at the cdc. Dr. Khan, great to see you. Let me pull up the Positivity Rates as of this morning in some major states and hot spots. Arizona is having a Positivity Rate of 28 . Meaning that of everybody who gets tested, 28 come back positive. Texas, 26 . Florida, 19 . If you were in charge, do you think those states should shut down today . Good morning, alisyn. And spoton, so five states had their highest peaks yesterday. And i think about half states had their sevenday peaks. This is an outbreak that is uncontained in prefall. If youre not doing the four things weve talked about in the past to get this outbreak under control, starting with test and trace, thats been successful in europe, canada, many countries have eliminated disease. So if you cant get those right, your only option is to shut down. Only option is to shut down. Because we know, by the way, that testing is hitting a ceiling in some places right now. Theyre having a hard time keeping the testing up in california. Theyre shutting down testing locations, because theyre running out of supplies. Were seeing long lines in florida and in texas. So you believe shutting down, just so people can see it. I think this curve, so people can see the daily new cases in the United States is astounding. Just how steep it is. Look at how much that has climbed since midjune. Were talking about weeks. Look how steep that curve is. And do you think the only way now to change that is to shut down . Well, we had four options. The four options to get this outbreak under control that we know work. Leadership, test and trace, get cases down in our community, wear masks, wash your hands, the Community Engagement part and drop deaths with dexamethasone. So if were not dropping deaths in our community with test and trace and masking, then, yes. Zpa and states are already doing that. Theyre shutting down bars and restaurants, because if people dont come in contact with each other, they cant cause disease. But how can we talk about going back to music events, stadiums, see the movies when we cant even go back or go to school, when we cant even go back to restaurants and bars at this point. Lets talk about schools. Because, obviously, we heard the president yesterday demand, basically, that Public Schools across the country be open for inperson learning. And then after that, the cdc said they would revisit and revise their guidelines. Let me just pull up the guidelines as they stand right now for how to, they believe, safely reopen schools. Wear masks, i assume, they mean, for students and teachers. Keep desks 6 feet apart. Stay home when appropriate. Meaning if youre showing symptoms, i think. Stagger arrival times and dismissal times and have backup staffing plans. Also, close communal spaces. Cancel field trips, large gatherings. What, doctor, is so onerous about those guidelines . So, alisyn, theres nothing onerous. Actually, theyre pretty standard guidelines. These are the type of guidelines im writing with individuals all over the u. S. , these days. And if anything, theyre mild. Because what you notice is not in those guidelines is triggers. So, which we put in our guidelines. At what point do you open schools . Right now in arizona, theyre seeing 450 cases per million, per day. Is it okay when you cant open a bar or restaurant for kids to go to school . So those guidelines need to be strengthened, as are all other guidelines coming out from cdc to say, this is our range. And unless youre in this range, we dont think its appropriate to open. So, yes, open, but open safely. Those are guidelines, by the way. Those arent rules. Not saying that states have to do this, but it just helps instruct these School Districts for how to do it. Doctor, what questions do you have and what answers do we now have about transmission in schools . So the good news is that it looks like theres little transmission within schools and children really dont play a large role in causing transmission not just in schools, but causing transmission in communities, which they do in influenza, which is one of the reasons we first shut down schools. But that said, you know, kids still get infected, they still get complications, they still get this disease called multiinflammatory syndrome of children, so its not like theres zero risk to our children. So like many, i want our kids to go back to school, but they have to go back to school safely. And thats what the cdc guidelines say. If youre going to send them back to school, here are the measures to put in place for them to go back safely. But i want to see the cdc guideline go one more step and say, unless you have 50 cases per million, per day, below that threshold, do not reopen schools for inperson activities. And that should force people to get Community Transmission down. Tha thats what we need to do. Sure. But i feel that the guidance on schools is very mixed. If children have are showing that they are not transmitters, so, yes, of course, there are the tragic cases of kids getting the inflammatory syndrome, of course, there are the tragic cases of kids actually transmitting it to someone who can be vulnerable and get sick, but if in general, for the vast swath of children are not transmitters, then shouldnt we be pushing to get them back in school . No, absolutely not. Unless you drive down Community Transmission. Because youre still going to get outbreaks in schools. So, yes, the kids arent going to get very sick, but youll still get outbreaks in schools, there are still teachers there, vulnerable teachers within that group. So what will happen is youll sort of have this whiplash, which is youll send your kids to school, and all of a sudden, youll have three, four, five cases in the school, the school will be forced to shut down 5 to 14 days and you repeat that again and again, and before you know it, the School Districts are all shut down again. You have to get Community Transmission down. Thats best way to protect our kids and get them back in school safely. Dr. Khan, rapidfire, given where things are, should texas be opening schools right now . Absolutely not. Should arizona be opening schools right now . Any place above 50 cases per million per day should not be talking about opening schools today. Florida . No. California . No all right. I think i get the point. But thats not stopping President Trump from traveling there tomorrow. The president will also hold a rally in New Hampshire on saturday. Heres some news this morning. Remember tulsa . Thats the last place that President Trump held a rally a couple of weeks ago . Well, now, a couple of weeks later, tulsa is seeing a Record Number of cases. Joining us now, cnn Political Correspondent abby phillip. Now, Health Officials in tulsa wont tell us whether or not the cases are coming from people who are at the rally. Privacy concerns, and i get that, prevent them from telling us what the Contact Tracing has told them. But, they all say, the rally was two weeks ago, now were seeing record cases. Yeah, theyre basically saying, connect the dots. That its clear that the rally and we should be fair, there were a lot of people in tulsa for the rally. There were a lot of people in tulsa for the counterrally that actually only came into existence because the rally was being held there. So all of these different groups of people coming into that city at that particular time, yeah, its going to end up leading to some kind of transmission. And the only group that seems to be completely uninterested in talking about it or dealing with the consequences of it are the president and his campaign. They continue to schedule events. They continue to talk about their convention thats supposed to be held in just a few weeks, where now were learning theyre planning on testing everyone, because they know that they cannot just bring people together in large groups without the virus transmitting and causing problems locally for these officials, who frankly were having to have a downward swing, not an upward swing, that they could control, where they could handle the cases and the hospitalizations. Its a good thing they had so many people sign waivers. All of those people sign legal waivers to not sue President Trump after they got sick. Phew. I mean, im sure theyre relieved that they decided to do that. Will they be doing that for the future rallies and convention, as well . You have to assume that they will. But, you know, i mean, its not even about, as much, the people who attended the rallies as it is about all of the people that they come into contact with at restaurants, at bars, at when they go home, when they travel on airplanes. I mean, you know, you can sign a waiver for yourself, but what transmission is about, is about other people. Theres no accountability for that. We actually saw it really vividly when the president had his fourth of july event in south dakota with one of his not family members, but his sons girlfriend, Kimberly Guilfoyle, sick and doing events in close quarters with people, with abandon, not even really taking basic precautions. And now, just last night, actually, Kimberly Guilfoyle was on a trump event, really kind of joking about the incident, which is frankly not very funny. The number of people who could have been who could have interacted with her and contracted the virus because of that kind of behavior is, you know, we cant even really calculate what thaent ends up being. Look, its good news shes feeling well, but lucky, given the circumstances. Overnight, abbey, we heard dr. Anthony fauci saying states who are seeing a spike in cases should consider shutting down, clearly and vividly. In stark contrast to what the president says, we are not shutting down again, period, full stop. And its not the only time that the words of the president seem to be in direct contrast to the words of scientists, including dr. Fauci. Listen to this. Well, i think we are in a good place. Were facing a serious problem now. Were almost up to 40 million in testing. 40 million people, which is unheard of. This is the thing that is a little bit concerning. You say, well, we now have 37 million tests have been performed. The question is, when you get on the phone and talk to the people in the community, there are still lapses there where the dots are not being connected. If you look at the chart of deaths, deaths are way down. Its a false narrative to take comfort in a lower rate of death. I have to say, abbi, there are times when i actually think dr. Fauci is saying things carefully, but to directly refute some of the ideas that the president is getting out there. And whether or not he is doing it intentionally, theres just no question that theyre in direct opposition. Yeah, its really extraordinary. And i do think that dr. Fauci, who has been around this town for a very, very long time, is cognizant of the importance that he not really sully his reputation and good name. The polls show people trust dr. Fauci to give them the truth. So it actually is really important for him to continue to do that, because the narrative from the president in particular is so detached from reality, from the facts, from the data, that theres no way that a seriousminded, scientific mind would simply say, yeah, lets go along with the most positive version of this picture. You know, dr. Fauci was not at the Task Force Briefing yesterday. There was an explanation for that. He was told that they should only go in person to the briefing, if they were invited. But, you know, its really telling that the one official that sort of people trust to give it to them straight was not present there, but fauci isnt taking that lying down. As you can see, hes doing public availabilities, hes doing media availabilities, and hes being frank with the public. This is a problem that were in, and hes urging states to take extraordinary steps that the white house refuses to urge them to do, because the white house is very more interested in reopening than they are in containing the virus, truly. Skbrus and just as people were starting to get their jobs back, theyre now filing for unemployment for the second time. For over two weeks, warren kuvic battled covid19, isolated in his apartment in ft. Worth, texas. It was brutal. A constant beating on your body. Reporter he believes he got the virus when he went back to work midmay, when bars in the sta state reopened nearly two months after being shut down. I really thought we should have waited a couple more weeks. You have to make that choice when youre in this type of business between your health and safety and working. Reporter now bars in texas are closed again. And he is out of a job again. He was one of 2 million texans plied for unemployment from midmarch to midmay. Weekly claims started to drop when bars and restaurants reopened. But now, like covid19 cases in the state, unemployment claims are on the rise again. I dont know if or when ill be able to go back to work. I got about a month and a half, maybe two months, before it gets super tight. Reporter its also getting tight for bartender randi heightsman. She bought a brandnew car in february and just furloughed for a second time. Not what i would have done if i would have known i was going to go on unemployment and not be able to work. Reporter the extra 600 a week in enhanced unemployment expires at the end of this month, leaving her in financial jeopardy. If that extra 600 goes away, that is gone. That doesnt even cover my rent. Tha thats 200 to 300 a week. Thats not livable for anybody at all, let alone somebody that has bills that are for somebody thats used to make somebody twice that in a day. And john, the bartenders we spoke to say they dont understand why wearing a mask has become such a political debate. One of the bartenders put it to me this way. He says, its the simplest act of kindness that one can do. And he believes its one of the only ways that hes going to be able to get his job back, john. The sad thing is, its too late for some of those bars in texas and other states. Developing this morning, new transcripts detailing the final desperate moments of George Floyds life. They were taken word for word from the body cameras of two of the Police Officers former Police Officers, who are charged in floyds death. Cnns omar jiminez joins us now with the details. Much more detail, omar, than we had before. Reporter thats right, john. This transcript comes as the defense attorney for former officer thomas lane files a motion to dismiss the case against his client. Now, it gives new insight as to what exactly happened leading up to George Floyds final moments, starting with officers, or i should say, including officers trying to get floyd into a police car. Remember, they were responding to a call over a fraudulent 20 bill being used. Floyd said he was claustrophobic. There seems to be a bit of a struggle. And from there, floyd says, okay, okay, i want to lay on the ground, i want to lay on the ground, i want to lay on the ground. Lane says, youre getting in the squad car. Floyd, i want to play on the ground, im going down, im going down, im going down. Then they go to the ground. Floyd says, im through, im through, im claustrophobic, my neck hurts, everything hurts, i need some water or something. Please, please, i cant breathe, officer. Then officer Derek Chauvin says, stop talking, stop yelling. Floyd, i cannot breathe. I cannot breathe. Theyll kill me, theyll kill me. I cant breathe, i cant breathe. At one point, the transcript shows that lane asks if floyd should be moved to his side, to which officer Derek Chauvin said, no, hes staying put. And thats part of what lanes attorneys are arguing in their motion to dismiss, that lane deferred to a senior officer on the scene. They argue that lane had no reason to believe a crime was being committed. And im quoting the attorney from the motion here saying, chauvin was calmly positioned near floyds neck and back area. Chauvins attorney officially has no comment at this time. And its important to know, we havent seen the video itself to corroborate the transcript, but so far, a lot of new details giving this, in some cases, horrifying insight. Alisyn . Omar jiminez, thank you very much for taking us through that. Joining us now is cnn chief legal analyst, jeffrey toobin. I think omar said it right. Its just as horrifying as when we watched the cell phone video. Its horrifying to hear how long george floyd pleaded to be able to breathe and for a little bit of help from the officers there. But legally, what do you hear, jeffrey . Well, its actually worse, i think, because, you know twb key fact, which somehow i dont think gets mentioned often enough is that floyd is handcuffed throughout this whole process. So there is no conceivable way he is a threat to the officers. He is simply trying to survive the experience of being arrested and warning the officers in how much peril he is. I think the other three officers, other than chauvin, other than the officer who had this knee on his neck, you know, they are going to have an argument. And there is an argument here that a jury can accept or reject. I dont see any basis where this could be used to dismiss the case before trial. But i mean, this does seem like an appropriate argument for the other officers to say, i was not involved, i was deferring to a senior officer and a jury can address that. But just the overall horror of the picture of what happened is, as you say, only worse now that we have this transcript. Jeffrey, lets move on to whats happening today at the Supreme Court. Its a very big day. Today, will we learn, finally, whether or not we are going to see Donald Trumps tax returns and financial records . Let me give you a ringing maybe on that. Because there are two cases before the court. One is a subpoena from a grand jury in manhattan, the new york City District attorney for financial records, including the tax returns, and the other is a subpoena from congress. If the grand jury case goes in favor of the prosecutors, that information will only go to the grand jury and will not be made public and may never be made public. The congressional subpoena is much more likely to be made public, the results of it. Its also possible that trump could lose, but the Supreme Court would send the case back to a lower court to resolve certain details, which might eat up several months and give donald trump a win of keeping it all secret before the election. So, this case, unfortunately, like a lot of legal matters, is a little more complicated than will we see them or will we not . So it really doesnt go the way it does on tv, like all the law order shows awatch, t s. I wont know within one hour. Law order is exactly true. They make that cool noise. Good. What is the argument in favor of revealing Donald Trumps taxes and financial records . And what justices will you be watching or what clues are you listening for . Well, the straightforward argument here is no one is above the law. Grand juries have broad powers to subpoena evidence in criminal investigations. Congress has broad oversight powers and the president is a citizen like everyone else. The president s argument is, this is simply harassment. This is only because hes president and it will distract him from his duties. The key figure, again, is john roberts, the chief justice. He, as i think many people know at this point, voted with the liberals in three big cases already this term. A big surprise to many people, including me. The question is, will he go against Donald Trumps party and donald trump personally in this case, as he did in those other three cases . So john roberts is very much the focus of attention today. And well know shortly after 10 00 a. M. This morning eastern time. Okay. Thats very exciting. Thats a great tease. Jeffrey toobin, thank you very much. All right. With the pandemic worsening and the white house appearing to be in denial, are front line workers and Public Health workers at risk of burning out . We keep hearing these stories of how demoralized they are. How they dont have enough ppe. We look into that, next. Come on in, were open. All we do is hand you the bag. Simple. Done. And this is taking a toll on Public Health experts. Joining me now is ed yong, a staff writer for the atlantic. He just wrote a new piece that says the pandemic experts are not okay. Ed, its great to have you on. We have been noticing this. We speak to Public Health experts every day. And increasingly, they look exhausted, exasperated, like this is taking a physical toll on them. Let me read one quote from your article, because i think its indicative of what you found. This is from one Public Health expert at georgetown. Quote, it feels like writing bad things are about to happen on a napkin and then setting the napkin on fire. What does that quote mean to you . I think these are folks who are trying to help us all. Theyre trying to pass a very complicated situation off a sciencebased advice to people on shows like this, to policy makers, and what theyre seeing is that their advice is being ignored. And that their predictions about the worstcase scenarios are coming to pass. These surges in cases that youve already talked about. And that is incredibly demoralizing to be trying to help your country at a time of need and to just have your expertise be devalued. And to see the nation walk down a path that you had warned about, that is dark and that could have been avoided. Its really dispiriting for them. What direction do they think we are heading in this morning . I think its a bad one. I think its selfevidently a bad one. Weve warned that there is a long data lag between people making risky choices, the policy makers allowing people to make risky choices by reopening too early without testing and tracing in place. Theres a long lag between that and cases and hospitalizations spiking to a degree that you can see. And thats what were seeing now, which means that the next few weeks are kind of baked in. Were going to see this get worse before it gets better. And while places are now starting to shut down, its going to take a lot of time for that to start to kick in. What kind of toll is this taking on these scientists personally . And you found that its particularly hard on women. Absolutely. So people are getting harassment, theyre getting huge amount of vitriol, as is always the case, women and women of color in particular are getting it much worse. This is incredibly demoralizing. People have been working nonstop since january. Theyve had very little sleep. Theyre physically tired, theyre emotionally tired. And i really want to make clear that expertise, which we need so much right now, is not a renewable resource. It comes in these people who are being burnt out. And if we dont protect them, if we dont start listening to that advice, were going to lose that expertise at a time that we most need it. Because this pandemic is not going away anytime soon. What is happening to the science here . Youre suggesting that the science itself is at risk in some ways . Yeah, the science is not just an abstract concept that floats out in the air. Its not like this thing that we can just grab when we need it. It exists in the minds of people. People whose expertise who has been devalued. People who have been running on fumes for months now. And, you know, if we dont start thinking about them, if we dont start empathizing with them and actually listening to that advice and using it to inform our decisions in our daily lives, i think its a huge problem. I think were going to use a lot of the folks who need not just in this disaster, but in all of the pandemics to come. Hurricane season is upon us. Like, we need to be ready. Who do they blame for this happening . Who do they blame for the politicization of science . Its such a complicated question. I think with this i dont think the people i spoke to really blame anyone. Theyre not really that type of people, but im putting the blame on the federal government. I think that we all, including these experts, spent a huge amount of our own, you know, emotional fancy staying at home, you know, changing our lives in order to buy the country time, so that it could steel itself for whats to come by ramping up testing and tracing and putting all of these measures in place. And no plan was put in place by this administration. That time that we all bought the country was wasted. And thats why were seeing these surges now. Thats why the people ive spoken to have said, this was predictable and preventable. And thats why everyone is so frustrated. They were warned, they didnt listen, and now were seeing the consequences. America now has surpassed 3 million confirmed cases. This morning, 33 states are seeing a rise in cases. Just three states declining. Some of the hardesthit states reporting alarming Positivity Rates. That means that 28 of the people being tested in arizona have coronavirus. Hospitalizations
