The government allegation he was passing nonpublic information to his son, cameron collins, who is also dieted. Then the son was passing the information to other people, and they were trading on that information. Look, he was the guy who knew what was going on here. He knew that there were some negative results according to this indictment on his drug trial. And he then took that information, the government says, and passed it along. The other thing i think thats interesting here is that they are using in this indictment they talk about how he tried to conceal the trading and issues surrounding the drug stock. One point in this indictment they mention how his office had issued a statement to a local reporter and the statement said, people who have gone to prison over things like this, you think about martha stewart, for example, it is not necessarily about the security fraud. It can be about false statements and thats a key here as well. What statements did you make to the authorities when they questioned you about it. Right. That ends up often being, especially large public officials, thats how they often get caught up. Weve heard this again. This has been floating around for years. That behind the scenes, he would bring in folks from nih or from relevant agencies and talk to them about the National Institutes of health. National institutes of health and talk to them about this company and about some of the drug trials. Again, said he wasnt doing anything untoward. He just believed in the company. Just one of those things how is that legal . It kept raising concerns. Look, your questions are the same questions a lot of lawmakers had, same questions a lot of outside advocacy groups were concerned about as well. Thats precisely why the Office Of Congressional Ethics began an investigation. It is why they referred it to the house ethics committee. Paul, you have read through this 30page indictment. Walk me through what stands out to you most. Happened apparently it is alleged here by the justice department, it happened while at a white house picnic. Thats right. And it happened this is a call from him to his son. Now this call comes after collins, the father, the congressman here, according to the indictment, this happens around june 22nd, 2017. The father, christopher collins, gets an email from the ceo of this drug company, innate, basically saying it was to him and the Board Of Directors that the drug trial had been a failure. Right . Pretty big deal here. Then within less than an hour, at around 7 16 so the father, the congressman, gets the call around 6 55. At 7 16 there is a sixminute phone call, according to the indictment, and in the phone call they say that during the sixminute call at 7 16 p. M. , christopher collins spoke to cameron collins, his son, and told him in sum and substance that the drug had failed the drug trial. He conveyed, it says, the material, nonpublic information, to his son knowing that it was a breach of his duties to the drug company and anticipating that his son would use it to trade and tip others. So that is the essence of the charges here, of the indictment. Its not clear how they know the sum and substance or what that conversation was about. Whether it was the son or the congressman was being wire tapped or somehow during the investigation maybe the son may have told investigators. But that is essentially paul can talk about this more certainly is the crux of these charges, of these allegations. Shimon, stay with me. Ive got three key players here according to the governments indictment here. Whether they all have the same story, whether they all say the same thing, what these false statement charges are stemming from are all still big questions. Yes. This series of calls demonstrates that you have information from the ceo of the company, passed along to Congressman Collins who sits on the board, who immediately passes the information, by telephone, along to his son. The son then starts selling shares off the next morning. Now the defense has said, by the way, in a Public Statement already that he lost money on the trade, and therefore this kind of looks like this wasnt an attempt to profit on inside information. But you can profit on inside information by limiting your losses. There may be the claim that well hear later this afternoon that by selling right away when you sell. Yes. Before the public became fully aware that this drug trial had failed and that a particular drug was going to decrease in marketability. You got an advantage over the public. I think it is notable looking at the statement from his defense attorneys, this line. They say, it is notable that even the government has not alleged that Congressman Collins traded a single share of innate stock. It is not just about you sell or buy or trade on. It is what you pass on and what is done with that. Right. It is nonpublic information that you have and give to the public. His lawyers are making a point. I remember when this happened because there were headlines about the biggest investor, a sitting congressman, got crushed when this when the trial ended up not doing as well as it was supposed to be. Millions of dollars potentially lost. I think he had Something Like 18 , 19 of the stock at the time when it happened. But again, it is not just if he took losses or if he was selling off stock. Its if he was telling somebody else as well which appears to be and are you trying to help your Family Members your son, the father of your sons girlfriend, are you trying to help them profit or at least lose less. Thats key here as well. Lets go to capitol hill. I think we have manu raju standing by . Whats the reaction . Reporter so far silence. Weve tried to reached out to the speakers office, get a sense on whether they have any reaction. Probably waiting until the Press Conference and Chris Collins releases a fuller statement about this. One thing thats becoming clear from just some early indications from people close to collins is they are going to fight this pretty aggressively. You saw that statement that you were showing earlier saying that they do not believe that there is anything that shows any wrongdoing. They believe that he will be exonerated. In a lot of ways they look at what happened to bob menendez, the democratic congressman senator from new jersey indicted on federal corruption charges but he was acquitted on those counts earlier. They view those as a model of sorts. They believe this is something they can fight, it is going to be a battle a lot of ways in the Pr Battle Ahead of the election time to try to convince voters and try to convince the public that he didnt do anything wrong here and that he is being a victim of a witch hunt of sorts. The ultimate question, too, is how much does the white house, in terms of the president with being get behind Chris Collins whether or not they believe what Chris Collins has to say because collins was one of the president s earliest supporters, probably one of his earliest supports on capitol hill, day in, day out, during the 2016 primary campaign he was defending donald trump and no doubt the president remembers that and rewards loyalty. What does the president do right now . What does the white house do right now when one of its closest allies has been indicted on some very, very serious charges and which collins himself has said hell fight very hard to clear his name. Well wait to hear what the Republican Leadership has to say. But so far, silence from capitol hill as members start to digest this very surprising news this morning. Quick followup on something you said that i think is important. He said if they try to say, look, this is like senator bob menendez who had these federal corruption charges against him. It is not really apples to apples. With securities fraud, it is different. With menendez, it was, was it a quid pro quo for these things. The government in the 30page indictment lays out the evidence they have against him. It is not an exact apples to and manies comparison. I would be intrigued to see how they try and roll this out. I think more broadly menendezs defense was explicit and robust and unyielding. I would imagine knowing if Congressman Collins and having dealt with Congressman Collins for the better part of the last couple of years thats absolutely the role that hell take. Again, one of the interesting elements about this is how public hes been and had been about his role at the company, his believe in the stock and his believe in the company. As you said, Rudy Giuliani this morning saying that theyre sending their counteroffer to the Special Counsel after they had received an offer from the Special Counsel last week, a letter stating that they would limit some of the questions. The key question here is will the Special Counsel be allowed to question that is in person, sit down with the president and ask him questions about obstruction, Rudy Giuliani and the trump team are trying to limit that. Let me read something from Rudy Giuliani that our dana bash got. Essentially what Rudy Giuliani says is that it is a good faith attempt to reach an agreement. He then says there is an area where we could agree. If they agree, meaning the Special Counsel. So clearly negotiations still under way. We dont know exactly what the trump team is trying to do here, what their offer is. We know that they were trying to limit the questions of obstruction because obviously that is where perhaps they feel that the president has the most sort of kind of chances of perhaps maybe facing some kind of violation, some charges or there may be a report that may be issued which would be negative on the whole Obstruction Issue so they were trying to limit his exposure on that. We dont know exactly what Rudy Giuliani and the team is presenting to the Special Counsel. But nonetheless, significant in that they are still negotiating, still trying to work this out. Okay. Thank you very much for walking us through that. Lets get the legal take on it. Paul callan, we know Rudy Giuliani indicated to politico when it comes to questions about obstruction, quote, well leave a little wiggle room. The issue is not whether the Special Counsel is going to ask the president these obstruction questions. It is whether they are all in writing as the president s team wants them to be, or whether mueller can get some in this person. Why is that so significant . I think it also goes beyond that. Giuliani has previously said that it is the position of Trump Lawyers that mueller only has the right to question the president about information he cant get from other sources. In other words, by getting it from documents or even from aides that hes interviewed. Whats left . The only thing thats left is what was the president s intent, what was in his brain when he fired comey, when he made various statements. Giuliani said, well, we might let them ask a couple of questions. I can assure you that the mueller team is not going to accept that position because any prosecutor knows that you have to follow up on initial answers. People try to prevaricate and try to avoid getting to the point. Sometimes it takes 20, 25 questions to get someone pinned down on a specific fact. I dont think this is going to be productive at all if this is the position the president will take. This has been a langi hangin months and months, whether the president would sit for an interview. We are also following the trial of Paul Manafort in virginia. The defenses ended his Cross Examination of manaforts deputy rick gates. A live report outside the courthouse next. Gates was asked about a meeting in july of 2014, a time when he and mr. Manafort sat down and talked to the fbi. One of the main takeaways from that testimony is that it was gates now testifying at the end of his cross that mr. Manafort told him to be open and truthful with the fbi in discussing the various overseas offshore Bank Accounts that are at the very root of this entire case. As you know, poppy, it has been a tough few hours on the stand for mr. Gates because, at the end of the day, not only did he have to admit and talk about crimes that he said he committed with manafort, but they also really got into his character and brought out all of the questions about lies, as well as even cheating on his wife. Talk about all weve learned in the last 24 hours about him. Weve learned personal issues of dishonesty, having an affair, and this all speaks to trying to poke holes in his credibility. Right . By the defense here. Weve learned that he faked an investment document. Weve learned more about the money that he admits that he stole from his boss, Paul Manafort. Weve learned that he lied to investigators. Even earlier this year when they were trying to cut a plea deal with him. Let me read you some of the back and forth between manaforts lawyers, the defense here, and rick gates. It is striking. Quote, from manaforts lawyer after all the lies youve told and fraud you committed, you expect the jury to believe you . Gates responds yes, i made a decision. Im here to tell the truth. Mr. Manafort had the same path but i am here. Hes trying to say, look, i cooperated, manafort didnt. You should believe me more than you should believe manafort even though i am an admitted liar. How is the defense doing with this strategy . So, they had to do two things. I think of thiss done one of them. The one that theyve done effectively is dirthying up rick gates. He now looks like a bad guy, he now looks like a liar and a thief. Thats fine. The prosecutors arent going to say anything different in terms of hes a criminal and he lied in the past. What the Manafort Team has failed to do is distance rick gates from Paul Manafort. Theyve shown hes done all these things, but not that paul manafort wasnt right with him doing that. They didnt underestimate the testimony of the prior witnesses, accountants and bookkeepers that showed that manafort was deeply involved in this and they didnt meet their promise in the opening showing that rick gates did all of this by himself. I think thats where they fall down a little bit. Well have to see if they make up that ground on a defense case. Youre right. They said this is all the doing of gates, not manafort here. But of all the words you could use to describe this race, nailbiter comes to mind or bellwether certainly. Hard fought. Fewer than 2,000 votes separate Troy Balderson from democrat danny oconnor. At last check at least 8,000 provisional and Absentee Ballots remain to be counted. This is the latest example of a district thats been solidly republican for three decades until maybe now. Thats not even the closest race we are watching. The gop Gubernatorial Race in kansas, now fewer than 200 votes between the incumbent and ones point, the incumbent didnt get the president s backing. The host of firing line. And also margaret bush. It is like Appointment Television in my house. So much news to start with. I actually want to start on Breaking News with you, as a republican from new york, a strategist, the fact that we just saw moments ago there was this indictment of securities fraud, wire fraud, false statements against republican congressman Chris Collins. They say they are going to vigorously defend him but this guy sat on the board of a big Pharmaceutical Company and is charged with insider trading. Any individual, regardless of a republican or democrat who has the Publics Trust and confidence, serves in elected office this is alleged uses that power and privilege to enrich themselves, to line their own pockets and to enrich their friends and family should be held accountable. There have been ethics investigations going on for some time now and he surrendered to the fbi this morning. It doesnt matter if you are the president of the united states, the president s Campaign Chairman or lowly member of the house of representatives. If you are abusing the Publics Trust for your own enrichment, you need to be held accountable. The Southern District of new york has a Press Conference in about an hour and a half. Moving on to ohio, john avlon, if democrats can eke this out, this would be really big. This is a district the republicans have held for threeplus decades. But if you look at The Big Picture nationally, whats it tell us . Even though democrats may fall short here too soon to tell 8,000 votes this is a district the rigged system of redistricting designed to have it not be within democratic grasp. Not only for 30 years in republican hands, but the previous republican incumbent won by more than 30 points while trump won the district by 11. You say this morning there are no silver medals in politics. Thats right. Second place gets you o bl obliterated. But you get a Second Chance in november. You can claim a moral victory by being massively competitive. This thing is not over yet but it appears the republican does have the edge. That said, the suburbs in the country this is a National Theme the suburbs seem to be swinging towards democrats and away from republicans. Thats key in any election, particularly true here in the columbus race. Also republicans dramatically outspent in terms of Outside Money for democrats. Five times. Yeah. 5x. I had endorsed a candidate in the primary. We are not yet in a position where nationally right the generic ballot is not doubledigits ahead. The president s not doubledigits beneath in the generic ballot. It means you need to go district by district and pick candidates. This was a district of suburban voters who have begrudgingly gone along with trump but they dont love trump. Republicans have could done better and avoided this by picking a better candidate. Democrats picked a great candidate. We are still at the point now as we head into november where we are still going district by district and whichever candidate is better for the district is more likely to win. If the generic ballot gets to the place where democrats are doing ten points better than trump generally, thats where you talk tsunami. What about the growing democrats gap when it comes to urban and suburban voters versus rural. If you look back and look to bill clinton in both elections, then barack obama being down 20 points when it comes to rural voters, and you look at trump winning the rural vote by 40 points. The democratic partys got a problem here. Its got a real problem when it comes to reaching out to rural voters. The original red blue divide in not democrat versus republican, its always been urban versus rural. The suburbs have been the swing this recent decades. While republicans are dramatically outpacing in rural counties, the fact that suburbs swing toward democrats with the cities that math is tough to beat but that gap, while its been a persistent theme in american politics, is really troubling because it highlights that kind of cultural polarization we are seeing in our country that leads folks to start seeing fellow citizens as not being opponents but enemies. Thats the dangerous thing. This tells me that Troy Balderson may very well lose in november. This is hes just got campaign for three months. Chances are he barely won. The likelihood that he wins again all things being even db but th after this. Ias a republican strategist are you nervous . 12000 . Ive never been a strong supporter of President Trump. That puts me outside the mainstream the party. Im fighting for republicans who believe in lgbt issues, climate change, a series of issues that people would claim are moderate positions. Let me just get your take on the Breaking News that your fellow republican in congress, chris collins, has been indicted by the federal government on very serious allegations of securities and wire fraud. I know you dont serve on any relevant committees with him but you do know him as a member of congress. It is an investigation and i think it has to continue and well see what comes out of it. For this point in time, for me it is Breaking News and well have to continue to monitor it and see the outcome. Lets move on to ohio. We dont know whats going to happen here. Baldersons claiming victory, the president s claiming vict y victory. We dont know what will happen. Outside democratic groups in Ohio Outspent Rnc by 12 times. We saw the fact that a race that we had no Business Winning required 5 million of republican money, a visit from the president , and thats why keep winning in places where we have no Business Winning. We are competitive in a place where the congressman in 2016 won by over 30 points. I just asked Margaret Hoover so ill ask you. Is this a wakeup call for your party . Poppy, first off we have to realize this was august 7th. People are going back to school. As i was traveling the state and traveling the district, people didnt even know there was an election. Clearly there wasnt even turnout. Yes, it was a wakeup call that we want to make sure that people realize. But in november it will be different. November people know there is an election. Having an election on august 7th is not normal. People are getting red zi to go back to school, going on vacation, people are coming back from vacation. It is the dog days of summer. There will be a big difference in november but i do think complacency is an issue. I hear that. But your party did spend 5 millionplus to tell people that there was an election. We dont even know if it worked yet. That echoes this warning this morning from the Executive Director of the gop aligned congressional leadership fund, hes worried. Let me read what he wrote. We cannot expect to win tough races when our candidate is being outraised. Any republican running for Congress Getting vastly outraised by an opponent needs to vastly start raising more money. Is he right . In the end it comes down to, you can spend money but if people arent there or going to vote you will have these issues. In november we got to make sure people get out to vote. In ohio people are happy with the economy. People are happy with the 4. 1 growth. People are happy that theyre finally seeing jobs that are available and their pays going up. In the end thats the message. We got to make sure people are aware of that. Then we got to make sure they are aware that if we change direction that can be reverses. I think thats the key for november. President trump says essentially you saw his tweet. Im paraphrasing here. But he is the reason that balderson might pull this off, that balderson might win because of the president. Is he right . Well, clearly balderson won by, what . 1 or so . The president just came in to kind of help push that through. I would believe the president did lep. There are some who will say he didnt. But in the end him coming in will always help, especially in ohio. Some states dont like the president. I get that. But ohio he does have a favorable rating here. I think it was positive for him to come in and push to help. It was also good that governor kasich endorsed balderson as well. Sort of. I mean, yes, but at the last minute. I get to get you on this before i let you go. No mayor media outlet has called in race in ohio 12 yet. I understand the president has but we dont know who won this thing yet. Let me ask you about your race for sfla for senate. You are in a heated race with incumbent Sherrod Brown in november. This mayors abc poll has Sherrod Brown ahead of you 51 38 . So whats your strategy and why are you down double digits in a state that President Trump won by eight points and a state where Sherrod Brown is the only democrat to hold state wide office . The only poll that really matters is november. I was a busy guy finess guy for decades. When i got in washington, first poll, i believe it was marist, said i was down three points, then it said i was down by 21 points. I won in november. In the end, the only poll that matters is in november. When i travel the state of ohio, a lot of internal polls show this race is neck and neck. It is also about an incumbent democrat whos been around for 25 years in congress and 44 years with being almost his entire life, no politics. Thats the message thats important. Hes somebody whos said in 1997 we need to have term limits because people Shouldnt Be In Washington for 20 or 30 years. Hes there for 25. You have said, if you win, you would only run once again. To potentially serve two terms. Well be watching. Congressman renacci, i appreciate you being here. This ones for the ladies. Where did all the women go . Where did all the female ceos go . I think the pipeline is not as robust as it needs to be in the c suite. How many candidates . Only 330 of the 2,000 people in c suites of the fortune 500 companies are women. Thats 16. 5 are women. Thats the pool that that lot of Companies Look to, whos in the c suite that can actually move up to that post. It is a Pipeline Issue that weve got to concentrate more than people who are heading big divisions of these companies to see who is ready and not only concentrate on who is in the Corner Office right now. Ive been covering this for a decade and ive heard that so much, the pipeline, the pipeline. Its sort of like when do you stop talking about it and doing it . You have mandates in europe, for example Women On Boards in germany. Are we at that point . It begs the question. Because, eileen, when you look at whats happened in the last few months, ceos of campbells, hp, mattel, all were women, all of them now being replaced by men. All of them. And indra. Thats all true. We are stalled. As been pointed out, it is a pipeline problem. Catalyst has looked at this for years. We started studying this more than a decade ago about what is the barrier in that pipeline and the pipeline is not a problem until you get to middle management and a little above middle management. And then there are, if you want to use a metaphor for a pipeline, there are blockages in that pipeline. And a clear one is the stereotypical bias that is built in to Job Descriptions and Performance Management systems whereby we look at competencies and we describe them in terms that are so gendered, so male so women arent applying for some of those jobs . They arent being considered. Because when a Job Description says, we want somebody who aggressively drives sales, people look at a woman and say, shes too soft, shes not tough enough, she cant do it. Oh, by the way, no one likes a tough woman. So at the point at which she acts that tough, shes out. Its a selffulfilling prophecy. It is one of those downward spirals instead of a virtuous circle. Id be remiss if i didnt mention that every time a woman ceo is interviewed, i ask them when i interview them, youre asked about Work Life Balance and kids. Now i ask the men that, too. But it is a reality it is a huge juggle that goes on for both parents. Intoday told fortune this week i think my family was shortchanged a lot. Then it reminded me of what she said in 2014 about her tenure at pepsi and whether she was a good parent. Listen to this. I dont think women can have it all. I just dont think so. We pretend we have it all. We pretend we can have it all. If you ask our daughters, im not sure they will say that ive been a good mom. Im not sure. Motherhood stayathome mothering was a fulltime job. Being a ceo of a company is three fulltime jobs rolled in to one. How can you do justice to all . You cant. That was like a punch in the gut for me but i was so happy to hear her speak so candidly. Do we know more of that . We need to be candid and we also need to provide the kind of support for families, women and men, in Corporate America that really want to raise their children properly and want to be with them properly. I want to go back to that pipeline. You challenged the pipeline statement. I think what we need to do inside corporations is have women identified as leaders in their sectors, and then brought along and be sponsored. Not just mentored, be sponsored. Will you sponsor someone . You are the ceo of the company or the cfo of the company. You sponsor . Your reputation is also on the line in a large degree because you are saying this person is my next and we need to see more of that happening in corporations for women. It is a very good point. By men and women. And sponsorship is the only way for Board Service and for c suite activities through a career. Let me get you on this finally. You bring up a great point about Corporate America building an environment where we can be parents and work our tails off at the same time. My friend just went back to work at jpmorgan. She told me this weekend they have a Daycare Center across the street in manhattan where she can take her child free of charge for like the First Six Months or first year. She can go, breast feed. It was unheard of to me before. I worked at a company in the 80s that had that, too. Did they. Well, its not the normal. Its not. But it is changing.
