Paul welcome. Great to see you. Thank you for having me. Paul lets take this legal question starts with the assertion of alleged crimes starts with bribery. What you think of chairmanships definition of bribery . I suppose he is right if you accept the gerald ford famous definition of an Impeachable Offense that is whatever the majority of the members of the house of representatives decide what it is. You know, thats a political judgment and ignores history in the constitution. Lets start with the constitutional language which is where we should start. A president or any public official cannot be impeached unless a determination is made by the impeaching authority which would be the house that treason, bribery of other high crimes or misdemeanor has been committed but the only one. Paul the only one defined as treason so bribery they are now using bribery all the time. But that can be untethered from what the founders understood bribery to beat which was at least common law bribery and the founders were not unmindful of the fact that they were writing a constitution which had a congress which had the authority to pass laws including a federal bribery statute. Paul we have a current bribery statute. Does what the president did on the evidence so far qualify as bribery under that statute . Whoever, being a public official, corruptly demands or seeks personally anything of value in return for being influenced in the performance of an official acrid thats the bribery statute. Paul why does this not qualify . Ship says it does. In the context of what they allege is an illegal Foreign Campaign contribution, that being the benefit drive to donald trump personally of the announcement in a press conference of investigations in ukraine regarding the 2016 election charisma in the bidens. The department of justice has already opined through the Criminal Division and the office of Public Integrity that something as nebulous as an investigation is not of sufficient concrete value to constitute something of value under the federal Campaign Laws and the argument similarly under the federal federal bribery statement for second problem is adam schiff has tried to tie initially based upon the testimony to what the ask was for and that was according to him and the witnesses not much more than a meeting at the white house. If its a meeting and you heard the piece that you ran from adam schiff he is trying to make the argument to the American People that a mere meeting at the white house is sufficient to constitute an official act. Answer to that question is wrong. The Supreme Court in the decision which involved the former governor of the commonwealth of virginia, bob mcdonald set a meeting without it does not constitute as an official act. What about the delivery of military aid that the claim that it was withheld in order to extort this as a quid pro quo act . That there are other position but thats more difficult when you look at what the testimony was because the best you got from ambassador and fiona hill and several others is essentially that they presumed or assumed or it was implied that there was a linkage between investigations and Foreign Military assistance. You dont think thats been proved . Presumed, assumed and applied is not worth much more than what you think which is thats not proof that a crime was committed. Paul if the president said to somebody look we will not give you guys aid unless i see them investigate joe and hunter biden, would that be in your view, something that could qualify as potentially a criminal act . That potentially would be so. Thats the difference between an actual demand as opposed to what was expressed here in the call and also the benefit of the exculpatory information that we got from the investor or the president said listen, i dont want anything from ukraine but i want the president of ukraine to do what he said and he ran on which was to root out corruption. Paul he especially said i dont want quid pro quo according to the ambassador. Correct. Thats not insignificant for the second thing is the Lieutenant Colonel testified i as a military officer when im in a chain of command when the president asks or makes a request i assume thats an order. Thats true in connection with being a military people in the chain of command but last i checked president zelinski was not in the military chain of command of the United States. Equating a request with a demand which would be what was required in order to prove an explicit quid pro quo that would constitute corrupt intent thats not the same thing. I think they fall well short of the mark. Paul we have a little time left. Theyre moving to be putting together an article of impeachment on obstruction of congress because the president is saying john bolton and others cant testify. Paul, i think thats the weakest in this not just its one thing that bob rae says is the weakest but history says thats the weakest. We lived through other president ial impeachments and in the nixon case as well as the case involving former president bill clinton you can make that contention but its a weak one. Why is it weak . Because there are legit reasons for president on the basis of privilege to withhold information from congress peered where does that privilege derived . It derives from separation of powers. Thats a battle between the branches and the executive branch and legislate a branch. There are reasons why a president because of the sanctity of conversations and confidentiality necessary to do your job why he would want to protect those conversations from being disclosed to another branch of government. To try to turn that into abuse of office or contempt of congress is ridiculous because the question is whether those claims are legitimate and the only place to ultimately settle that is before a court and the democrats have decided to forgo that. Paul they decided not to contest Albert Roberts ray, thank you. We appreciate it peered when we come back the testimony of a massacre now seen as the linchpin of the democratic case fact is, every Insurance Company hopes you drive safely. But allstate helps you. Giuliani we would lose a very important opportunity to cement relations between the United States and ukraine. We followed the president s orders. Paul u. S. Ambassador to the European Union was the Main Attraction at this weeks public hearing. He testified on wednesday that the president instructed him to work with his personal attorney, Rudy Giuliani as giuliani pressured ukraine to public he announced investigations into the 2016 election and the Energy Company charisma. Was of the blockbuster testimony the president s critics claim . Lets ask Deputy Editor of the an Editorial Board member, kyle peterson. Damn, what did we learn that was new this week . I dont think we learned anything else that was substantively new here at all. We just listen to Gordon Sunderland described about how they all understood there was a Second Channel involving Rudy Giuliani and this is fundamentally what investors taylor said in their testimony last week. Paul it was clear long ago even in the phone call that trump was wanted this investigation. Yeah, as it was made clear in the interview with bob ray, former independent counsel, the democrats are arguing that somewhere in the center of this there is something that qualifies as bribery or extortion. I dont think weve heard anything in any of the testimony that establishes that smoking gun for the president and democrats. Its these shown insinuations that the president was pressuring people and used Rudy Giuliani to pressure them and i would say one final thing, and all the reporting about this when they finally say what do we get today in the testimony, what they got was pressure for the ukrainians to announce an investigation, rather than undertake in a mastication. That will be a crucial distinction when he gets to the trial in the senate. Paul one big issue is whether the president was justified in seeking it ukraine to ask for an investigation of hunter and joe biden to dig in to what happened in 2016. Do you think that was justified . Look, a lot of people are trying to figure out what the scope of this demand was. That is what is so interesting about the test money in general is that a lot of people were making a lot of assumptions about what donald trump wanted. And why this was being held. He seemed to have an overall sour impression of ukraine and corruption. If he was calling broadly for corruption investigation or calling broadly even for an investigation into what has become symbolic for ukraine corruption thats not a problem but you do wish if the demand was specifically for joe and hudson biden thats more problematic but is it a crime . No. It stinks but is it a crime . I dont think so. Paul what about that ukraine meddled in the 2016 election . There seems to be two stories here. One that the ukrainians hacked the dnc computers and i dont think theres any evidence for that even though trump seems to think that should have been investigated. On the other hand there is evidence from the ukrainian courts that a couple of ukrainian officials at least in 2016 to try to bring information to the democrats that ultimately was used against paul manna fort, thes former campaign chair. Yeah, and we know that there was a dnc contractor, this chill lupa, who was out there working with ukrainian officials to bring dirt about donald trump and ukrainian officials were on the record criticizing donald trump. Theres a legitimate basis for people looking into what ukraines role was in 2016. There are more than one country operating in our election. Paul in addition to russia but what about the quid pro quo issue, kyle, that Gordon Sondland stated flatly. In his understanding there was a quid pro quo and they said i presumed there was one. Was that a proven case . On the aide, i dont think it is. Thats one of the gaps democrats are trying to close. What the exact circumstances of that were in my President Trump held it up and why he ultimately released it so one thing we got this week also was a letter from ron johnson, senator ron johnson describing his conversations with the president about ukraine and he painted a different story. He talks about several of these meetings where it comes up in the president is skeptical for policy reasons and says why are we giving this aid and why doesnt europe pitch and so that complicates the factors and then the fact that we have not heard from anyone who has directly been in conversation with the president on why the aide was held up. Paul with you then say in addition to policy reasons, the president had personal peak going back to 2016 . For sure but he seems to be obsessed that russia did not meddle in the election for the question is what he did with that aid and how directly he told or did not tell his advisers that that was joe biden was the reason for holding it up. Paul dan, after two weeks will this change any minds on capitol hill or for that matter many minds . Yeah, it might change some democratic mines in a house on the question of whether they vote for or against because the polling needle has not moved. If it had moved at all is moved more in the president s favor so i think some of these democrats and toss up seats may decide they dont want to vote for impeachment. Paul when we come back, the centrists strike back. Democrats gather this week for their fifth president ial debates. Ends saturday paul as ten democratic president ial candidates took the stage at the fifth president ial debate in atlanta the battle for the middle was clearly on display with joe biden, cory booker and amy clover shark making their case to moderate democrat voters. They criticized far left ideas like the wealth tax, medicare for all and free college tuition. Heres the challenge. We democrats need to fight for just taxation system but as i travel around the country we democrats have to talk about how to grow wealth as well. The fact is right now the vast majority of democrats do not support medicare for all. It could not pass the United States senate right now with democrats. It could not pass the house. I think we have navigation as a party to be yes, fiscally responsible, yes, think big but we have peoples backs and are honest with him about what we can pay for. Paul kim, as you look at those comments what you make of it . Is this the sense that maybe we get the rise of the centrist democrats, at least against the what had been the ascendancy of sanders and warren . I actually think what this is is people heeding Barack Obamas advice this week to calm down a bit and if you go back and look at the shift between the first debates in which everyone was chasing after Elizabeth Warren and Bernie Sanders to get to the progressive left, lets decriminalize everything and get rid of the entire fossil fuel sector and lets give everyone free everything. You are now seen the candidates in a smaller field more willing to realize this problem are not winning ideas with the American Public or even with a big sector of democratic primary voters were not on the progressive left. They are finding their footing and more forcefully pushing back and realizing that a positive Campaign Idea rather than something that can hurt them. Paul i would also argue, kyle, they realized that warren and sanders theres no ruling to take their voters away on the left. Youve got to compete with biden for the other mass of voters who weve been told by many of the candidates are the majority of democratic voters and they are competing to see if biden stumbles and maybe they can inherit his voters. I think that is right though i think they could stand to go after warren and the sinners more strongly. They are still playing a little bit of patty cake here. Warren beatty significant concession last week and that i will do medicare for all but do it in the year three and after the midterm, my first midterms spinning. Paul which means she will not do it all but no one on stage was willing or able to sit eve every. Sanders said in my administration will do medicare for all in the first week but nobody went after her on that point and i thought it was strange. Paul how do you think joe biden gets, dan . I think he did well. I think all performed well, to tell you the truth. I think they raised their game. Joe biden a few stumbles but by and large last half of the debate he came on pretty strong. I think one thing that came through is the new emerging argument among these moderate democrats which is that they will talk about polarization. All of them, biden, mayor pete, harris and booker were making a big tent proposition and in the case of Amy Klobuchar they were feeling for votes from moderates, independents, even republicans so the idea is that donald trump has polarized the country and people are tired of that and we will let everybody like pete buddha judge said is welcome into our tent. Paul kim, thats a different theory of the campaign because the Warren Bernie sanders area of the campaign is that you have to counter Donald Trumps conservative populism with more leftwing populism economic restructuring and a radical agenda and that mobilizes their base. These other candidates are saying no we can make a case that grabs a big chunk of the middle from donald trump. Well, thats a stronger case, by the way. Look, why is Elizabeth Warren concession on medicare so meaningful . She was bowing to the reality that a big structural change is in fact that she and Bernie Sanders have been advocating, scares a whole lot of people and that if you want to win an election and if you want to then have an agenda that you get a look support behind its not going to be for big, crazy ideas like that. The theme that was coming out of so many of these candidates was we need to build on progress that weve made so far and stays true to our ideas but in a way that will not do bad things to the economy and scare the American People. Paul sanders and warren still have a problem is they split the progressive vote and it means one of them cant consolidate. If they could they might have an excellent shot at the nominati nomination. That is what makes the rise of someone like mayor Pete Buttigieg or other moderate is because they are looking at potentially splitting the biden vote and instead of biden and the twoway split you have a fourway split in and who knows what happens. Paul thank you all but still ahead, Pete Buttigieg trying to capitalize on his outsider status in wednesdays nights debate as polls show him surging in some early states. I have the right experience to take on donald trump. I get it is not the traditional establishment washington experience but i would argue we need Something Different right now. I wore the uniform of this country and know what is at stake at the decisions that are made in the oval office in the situation room. I know how to bring people together to get things done. I know that from the perspective of washington what goes on in my city might look small but frankly, where we live, the infighting on capitol hill is what look small. Paul that was democratic president ial hopeful, Pete Buttigieg making the case for his unconventional candidacy. He argues that the country need something more than a washington insider in 2020. The south bend mayor is surging in early state polls taken a tenpoint lead over both Elizabeth Warren and joe biden in New Hampshire paid a sevenpoint lead over warren in iowa. Kyle, how real is this Pete Buttigieg . Did you think of his case . I think hes playing a we can do pretty well. Hes talking well about his express but this is a guy who was the mayor of the largest town in North Central indiana. I think he will have to try to convince people who are 65 yearold voters that he is the guide they want to send to washington. Paul he is the outsider. Thats always been a big powerful fame in america politics. I thought his formula should about you think im from a small place, think about the small this of washington. Theres a lot of truth to that. I think hes playing it well. His rise in these early States Israel but you have to look deeper. Biden is still competitive for second in the polling in iowa and New Hampshire and cleaning up in nevada and cleaning up in South Carolina and thats a significant. Paul biden is. Correct. In a recent poll pete buddha judge had 0 against black voters and i dont know how hell do that. Paul is being an outsider and young and articulate enough of a rationale for his candidacy . Im not sure that it is. I think what democrats, the primary voters out there by and large are looking for the candidate who can defeat donald trump. That is their highest priority and if they could identify or wave a magic wand right now and say it is kamala harris, she would be number one. They want the person who could beat trump. An outsider like mayor pete is a little hard for me to see that. Having said that i agree with what Pete Buttigieg has shown as he can take a punch. He was up there on that stage whenever they attack him hes extraordinarily adept at turning it around and wait you just suggested and making a positive out of these negatives. He has real skills and its early in the campaign but if he wins iowa the fact that hes ahead of Bernie Sanders in New Hampshire is extraordinary, considering sanders background and reputation. Paul kim, if you look back in history democrats have a tendency to fall in love with these outsiders and it often works well for them with jimmy carter, 1976. No one knew where he was nationally and build clinton came out of arkansas, barack obama firstterm senator and they all one. Maybe democrats they tend to fall in love with this new, young charismatic person. Is that what is going on here . I was just going to say Pete Buttigieg reminds me of barack obama. Look at all the negatives, little name recognition, to some extent, a lack of experience but also at the same time this uniting message. I would wager most people cannot tell you what Pete Buttigieg policy proposals are but he is roderick and he speaks very well and talks about bring people together and democrats do love that. Right now kyles analysis of some of his weaknesses are very true but its also the case that if he were to win iowa and then New Hampshire he will get a big second look in those fall along states and it could be enough to propel him. There is a real shot for the s sky. Paul one thing that struck me at the debate as he got a free pass until Kelsey Gabbard took a month for his new mexico comments and i dont think that really took hold. His record in south bend on crime and education went unexamined. White . One reason the other candidates see him as a flash in the pan and are waiting for him to naturally run his course. Paul could be a miscalculation. That was the miscount elation when trump was running in 2016 but his policy proposals are going unexamined and is not all that close to the center of it he talks about medicare for all who wanted but before he made that his theme he was saying this was a glide past medicare for all and he wants to add six justices to this report and if a candidate wanted to take him on and say youre not a real moderate there is room for them to do that. Paul briefly, patrick, Mike Bloomberg is there still room for them to find a place in the campaign . After that debate it looks more difficult for them. As i said, those people conduct themselves in pre well but it looks to me with patrick and it looks as though mike is determined to get into the race. Paul and bloomberg is money bring still a head, a brutal crackdown on government protesters in iran is the attempt to reign in growing thomistic unrest. The government will begin to respect basic human rights, abandons its revolutionary posture and its destabilizing Foreign Policy in the region and behave like a normal nation the choice is clearly with the regime. Paul that was secretary of state mike pompeo warning ironic that the world is watching. Its a crackdown on protesters they are reportedly kills more than 100 people. Demonstrations erupted late last week after the government announced it would raise the price of gasoline by 50 . That decision met with widespread anger in a country where the economy is already reeling from u. S. Sanctions that were reinstated last year after President Trump pulled out of the 2015 nuclear deal. The founder and president of the foundation for defense of democracies, cliff, good to see you again. Lets talk about these demonstrations in iran. What triggered them in the gasoline price increased but how widespread are they and how much of a threat to the regime . No question, economic deprivation is part of it but it has gone way beyond that and you have the women who dont like how they are being told how to dress and have to wear key jobs and you also have its way spread out. Its not just the secularized from northern iran but the urban core and this is become a protest in more than 21 cities against islamist rule and against a ruling class that is a religious class that is not provided freedom not provided prosperity and has provided economic mismanagement and is corrupt. The rulers are hugely wealthy and people get that as well. It seems to be spreading its leader lists which is book of strength and weakness and will be difficult for the regime to put it down but they will try. Paul that is what it wanted to ask about. Weve seen these uprisings before. But each time the regime has been able to control them. Any sign, this time they may have a harder time doing it . Number of reasons. In 2009 there was an uprising very much like this and at that point president obama was reaching out to the ruling the country and did not even give support to it and to those uprising. In this case we have been given support and we should give morbid mike pompeo was clear to the president has tweeted in support and one of the things we want to do is resupply the internet which was cut on saturday so they can communicate. Its hard for reporters, western reporters, to get information out and i have reason to believe we have been helping provide some Internet Access over time. We probably can do more and it would be useful for democratic president ial candidates to say that in this they agreed with the Current Administration and support the people of iran as well. Because of the maximum Pressure Campaign among other things the regime has less money to spend on Security Forces or buying off various people which is one of the ways they do it. They like to send in Security Forces from other parts of the country or even from other countries because such Security Forces are more willing to shoot at protesters and kill them but more than 100 have been killed and thousands are arrested and many injured and we dont know where it goes and we seen most recently in syria the truly oppressive regime can do a lot. They can make half the people dead as a result of those supported by the terrorists. Paul you mentioned that good medications getting that message out to the iranian people and messages in as well but what about the more sanctions, the administration this week that it will stop issuing waivers on sanctions but there is also a socalled snapback sanctions that have not been triggered yet under the 2015 deal. Over that involved in what it matter . Two points. There should be many more sanctions friday morning and the ministration did sanction the Iranian Ministry of information and there are other targets as well. Snap act requires the europeans to get involved in the europeans have not im afraid characteristically theyre not they been committed about opposing despotism and supporting human rights in places like iran but we should have the europeans as well as us coming together and saying to the regime that we do not wanting to continue killing and oppressing these people. Is it possible to do that without the europeans . Its more difficult. Let me say that. Paul if the europeans went along and allowed the snapback sanctions to take place this would be a considerably larger level, higher level of sanctions then would increase pressure on the regime in your view . Would increase pressure on the regime and they would have to reckon with possibly the country imploding before the end of next year. Right now the strategy has been and theyve been advised on this that you can wait out President Trump. Who knows and you may get in in 2021. You may get a president who will want to get back into the jcpoa even though the rejections of the jcpoa, i ran deal that president obama concluded have already expired or will expire very quickly. You want to put the maximum pressure on not just from the u. S. But the european allies doing it as well. The iranians have been cheating and not just on the margin but in terms of the jc poa. Paul let me ask you, one final question. And people are saying this is the time that iran is back on its heels and this is the time for the u. S. To go in and say lets renegotiate a new deal. What you think of that . I think that possibility will come up president would take it but i fear is someone like president rouhani or foreign minister would say great, im a better player than any of these guys and when we negotiate with them. Then the president would be tempted, i fear, i hope not, to take a deal that is not good enough. The argument we had with the Obama Administration was that no deal is preferable to a bad deal and in the end he took a bad deal rather than no deal. I would not want to seat the same thing happen in this administration and i hope trump would go in and say either we get something that is important or we are out of it. Paul thank you, cliff may. Wall street journal editorial writer jason is here to explain. What is twitter actually going to do on a practical level . They have banned ads by politicians and political parties. There are still groups the promote issues like planned parenthood or the nra that can still promote their views on those issues so highly political issues, abortion and guns and so on but the rule that they seem to be trying to lay out seems to be it can be aimed at influencing legislation or court outcomes. That is hard to determine because the Supreme Court and legislators are deciding these issues all the time. Paul the Supreme Court has said that these issue ads are fine constitutionally. They can be restricted by congress as a matter of free speech. Twitter is a private actor and can do free speech but who will decide what constitutes or who will make these distinctions . If youre a climate Nonprofit Group and you think Climate Change is a big problem you supposedly allowed to say it but you cant be seen as promoting the green new deal. Who will decide whether youre too much time to promote legislation versus just promoting your view on an issue is regulators at twitter in san francisco. Paul doesnt that open them up to charges of bias on the both left and right. If you happen to be one of the people whose ads is taken down you will object. Of course. Absolutely. The policy is just not going into effect so i imagine we will see people start to object. Twitter acknowledged we will make it and its never a good sign when youre saying that preemptively. I dont think they know exactly what it is. Paul why did jack dorsey do this . It comes in the wake of Mark Zuckerberg is different policy at facebook. Any response . It certainly seems he was. Theres a frenzy about social Media Companies and political ads on social media committees so when Facebook Says it will not take Donald Trumps ad, the press and those in Silicon Valley got up stopped and jack dorsey seem to take it manage of this by issuing a sort of highminded announcement that you should not pay to get your message out. Thats not about free speech but about pain. Paul he was trying to one up zuckerberg in terms of saying im the virtuous one and we are the better platform for you. It appears so. And yet, hes ending up having to backtrack on that initial proclamation which are the dangers of trying to grandstand in that way. Paul we think about zuckerberg and the pressure that he is under . Its pretty enormous from the political left. They want him to basically say we will take down donald trump ads and we will take down speech that the left does not like. There are huge pressure. You saw dorsey try to one up him and now google is starting to regulate the legal ads more heavily. I think that zuckerberg though is a little wiser and savvier of the Political Landscape than the ceo of google and twitter and other places and he may understand getting into this political thickets is not good for him. Paul where facebook ended up in many ways is a safe political harbor that says look, essentially assumes politicians arent always going to tell the truth but its not our job to be the referee. It is the voices to fight it out and not to compete against one another. That is i would always happened in the United States. Politicians and press have fought over competing claims and the idea of getting sucked into it, i dont know why the ceo would want to do that. Youd be hit from all sides for every decision you make. Paul is zuckerberg whitley going to back down . Im concerned i think hes more likely to do restriction like what google adjusted where you severely restrict ad targeting. Paul jason, thank you.
