TERMS AND CONDITIONS OF ENTRY INTO .
“Phoenix Splore Giveaway”.
(“PROMOTION”).
1. Information on how to enter and prize details form part of these terms and conditions, however, to the extent that there is any inconsistency between these terms and conditions and any other published material, these terms and conditions will prevail.
By participating in this Promotion, each participant fully and unconditionally agrees and acknowledges that these terms and conditions are binding.
This Promotion is a game of skill.

2. The Promoter is The Better Drinks Co Ltd (“the Promoter”) of Suite 101, The Axis Building, 1 Cleveland Road, Parnell, Auckland 1151 (“the Promoter’s Offices”).

3. The Promotion commences at 10am (NZST) on Thursday 26 January 2017 and closes at 12pm (NZST) on Friday 3 February 2017 (“the Promotion Period”).

4. Entry is open to all New Zealand residents over the age of 18 years who submit a valid entry in accordance with clause 5 of these terms and conditions during the Promotion Period (“an Eligible Entrant”).
The Promoter, its associated agencies, the Promoter’s staff members and their immediate families are not eligible to enter.

5. To enter, Eligible Entrants must complete the following steps during the Promotional Period: .
A. Visit the Phoenix Drinks Facebook page (www.facebook.com/phoenixdrinks), and like the page (if not already a fan)..
B. View the Phoenix Drinks Facebook page post that asks “Want to win an unforgettable weekend for two at Splore? We have 2 tickets to giveaway.
Simply tag a friend who you’d like to share the weekend with and you could win 2 tickets” .
C. Submit a comment to this post answering the above question..
6. There is only one (1) entry permitted per Eligible Entrant.

7. There is one (1) prize available, two (2) adult Splore 2017 Festival tickets, valid for 17, 18 and 19 February 2017, at Tapapakanga Park, Deerys Road, Orere 2585, Auckland.
Approximate retail value (“ARV”) of the prize is NZ$500.
Prize is not transferable or redeemable for cash.
No substitutions except at the sole discretion of the Sponsor.
Promoter takes no responsibility for any variation in the prize value between the date of publication and the date the prize is taken.

8. The winning entry is determined by the Promoter.
Entries will be judged on creativity and relevance.
Judging will take place at 12.30pm (NZST) on Friday 3 February 2017, by a panel of judges from the Promoter at the Promoter’s Offices.
Friday 3 February 2017.
Winners will also be sent an email to the email address registered with Facebook.
In the event the winner cannot be contacted on this day, the Promoter will continue to attempt to contact the winner up until the Prize Claim Deadline outlined in clause 10 in these Terms and Conditions.
Entrants are responsible for keeping the Promoter informed of any changes to their contact information during and immediately following the Promotion Period.

9. The winner must claim the prize by 4:00pm (NZST) Tuesday 7 February 2017 (“Prize Claim Deadline”).

10. The winner’s double pass to Splore will be couriered to an address provided by the winner upon claiming the prize or emailed to them.
The winner may alternatively collect the prize from the Promoter’s address (laid out in Clause 2) during business hours.
The winner will be required to provide an acceptable form of ID to claim the prize as above..
11. In the event that the winner does not claim the prize by 4:00pm (NZST) Tuesday 7 February 2017, the winner will forfeit the prize and no alternate winner will be chosen.

12. All costs associated with travelling to and from Splore 2017 or attending Splore 2017 are the sole responsibility of the winner.

13. Prizes are not transferable or exchangeable and cannot be taken as cash.
No part of the prize may, without the prior written consent of Promoter, be re-sold or offered for resale at a premium (including via online auction sites) or used for advertising, charity fundraising, promotion or other commercial purposes (including but not limited to competitions and trade promotions) or to enhance the demand for other goods or services, either by the winner or any subsequent bearer.
If a ticket is sold or used in breach of this condition, the ticket may be cancelled and the bearer of the ticket may be refused admission.
Splore’s usual ticketing and venue terms and conditions apply to all tickets provided under this Promotion and by accepting tickets Entrants agree to be bound by their respective terms.

14. Promoter accepts no responsibility for any loss or damage suffered in the event that Splore 2017 is postponed, cancelled, rescheduled or relocated for any reason whatsoever.
If the prize or part of the prize is unavailable, Promoter reserves the right to substitute a different prize item of equal or greater value in Promoter’s absolute discretion.

If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
