These were whether the case was a fit one to be submitted to a martial law tribunal, and whether the articles were really seditious. On both points, public opinion in India had declared itself in unmistakable terms, and public opinion in this case was not merely the opinion of the general public, but also of men whose competence to express an opinion on the subject no reasonable person could dispute. Lawyers of the highest eminence, including at least one ex-High Court Judge, enjoying in a remarkable degree the confidence of the Government itself, shared and expressed the same view that the Indian Press as a whole as well as other lay critics urged with passionate emphasis.
