Late Wednesday the Minnesota Court of Appeals issued its final judgment on the interlocutory appeal of Judge Cahill’s order denying reinstatement of the third-degree murder charge against Derek Chauvin. Under the Court of Appeals decision, Judge Cahill was to apply the Court of Appeals decision in the
Noor case as binding precedent. He heard argument on the reinstatement issue from both sides first thing Thursday morning and granted the prosecution’s motion to reinstate the charge.
Please note, however, that the viability of the charge as a matter of law remains subject to a future ruling by the Minnesota Supreme Court in the
