A guilty conviction has ended the legal battle which reached the North Dakota Supreme Court and had two earlier murder convictions reversed has ended.
Chase Duane Swanson was one of two people found guilty in the murder of Nicholas Johnson, but had the convictions reversed by the state Supreme Court.
He was sentenced to life in prison again April 26, with the possibility of parole.
His original co-defendant, Madison West, made a plea bargain in September 2020 just before her retrial and was sentenced to 50 years in prison, with 15 years suspended, and three years of probation.
The pair had been convicted in 2018 for the 2016 murder of the Rhame resident in a local motel, only to have the convictions reversed by the Supreme Court on appeal because of improper jury instructions.

MANDAN, N.D. (AP) A Bismarck attorney is asking to withdraw as counsel for a man accused of killing four people in Mandan two years ago, citing a disciplinary complaint against him filed by the defendant.
It’s unclear how the withdrawal, if granted, would affect the timing of Chad Isaak s trial scheduled to start June 7.
In his request, attorney Robert Quick says the complaint presents a conflict of interest and that he is obligated to end his representation of Isaak.
The 46-year-old chiropractor is accused of killing RJR Maintenance and Management co-owner Robert Fakler, 52; and employees Adam Fuehrer, 42; and William Cobb, 50, and Lois Cobb, 45, who were married. Police have not established a motive for the slaying at the Mandan business on April 1, 2019.

BISMARCK, N.D. (Legal Newsline) – A mother and her daughter who was kicked in the head by a horse won’t collect the millions of dollars they sought from their cousins.
The North Dakota Supreme Court on April 16 affirmed a five-figure jury verdict, technically in favor of Melissa Oster and daughter N.B. But it’s figuratively a win for Josh Terwilliger and Samantha Seewalker, whose lawyers successfully argued against requested damages that included up to $1,260,316 in future economic damages and up to $5,589,704 in future pain and suffering damages.
After trial in December 2019, the Burleigh County jury awarded only $16,500 after choosing lower damages estimates in the range of what the defendants’ experts argued while finding Oster 45% at fault for the accident.

A man convicted twice for a 2014 murder in Grand Forks has been denied his appeal of an order denying his application for post-conviction relief, effectively blocking his path to a third trial.
Delvin Shaw, 36, is currently serving a life sentence for breaking into an apartment and fatally shooting one of the residents, Jose Luis Lopez, on June 24, 2014.
According to court documents, Lopez and his pregnant fiancee were asleep in their living room when two men kicked in their door and entered their apartment. Lopez charged the men, and in court testimony, his fiancee recalled hearing shots fired. Lopez died from four gun shot wounds later that morning at Altru Health System.
