An Indiana court has dismissed a lawsuit filed against a Roman Catholic Archdiocese by a former private school teacher who was fired for being in a same-sex marriage.
Marion Superior Court Judge Lance D. Hamner issued an order Friday in favor of the Archdiocese of Indianapolis’ motion to dismiss a lawsuit by former teacher Joshua Payne-Elliot.
According to the order, the court concluded that there was a “lack of subject matter jurisdiction” and “failure to state a claim upon which relief can be granted.”

An Indiana court delivered a religious freedom victory Friday to a school in the Archdiocese of Indianapolis, confirming the school’s right to ensure that staff promote an authentic Catholic education.
A former Catholic high school teacher, Joshua Payne-Elliott, sued the Archdiocese of Indianapolis in July 2019 in the case Payne-Elliot v. Archdiocese of Indianapolis.
Payne-Elliot was fired from his position at Cathedral Catholic High School after he entered a same-sex civil union, violating his employment agreement with the Catholic school, according to the Becket Fund for Religious Liberty, which represented the archdiocese.

The Biden administration wants to force doctors and hospitals to perform gender mutilation surgery on patients – even if it violates their religious convictions – and that demand mirrors another push for compliance.
In January, a North Dakota federal judge struck down what was known as the “Transgender Mandate” in Obamacare that required doctors and hospitals to perform gender mutilation surgery on physically healthy patients if they demanded it. The law contained no religious exemption.
On Tuesday, the Biden administration filed an appeal with the U.S. Eighth Circuit arguing doctors are engaging in discrimination by refusing to pick up the scalpel.
