A lawsuit alleging misconduct in the Morristown City Council race this spring and requesting a new municipal election was dismissed Friday by Chancery Court Judge Douglas Jenkins.
Rob Burke, candidate for the Morristown City Council seat in Ward 1, lost the election to incumbent councilmember Bob Garrett by four votes.
Burke alleged that problems with voting machines at the Lincoln Heights polling location and inappropriate conduct by Garrett on Election Day at the Morristown East polling location were serious enough problems to request a new election.
âIn the Courtâs opinion I havenât heard enough, even taking it in the light most favorable to you, to set aside an election,â said Judge Jenkins.
