Man photographed with foot on desk in Pelosi’s office released from jail pending trial in Jan. 6 Capitol riot Spencer Hsu A federal judge Tuesday ordered the release from jail pending trial of a man who was photographed with his foot on a desk in House Speaker Nancy Pelosi’s office during the Jan. 6 Capitol insurrection, citing an appeals court decision making it harder to detain riot defendants not accused of violence. Richard Barnett, 60, of Gravette, Ark., had been denied bond and jailed for nearly four months on charges including obstructing Congress, violent entry into the Capitol while armed with a stun gun and stealing a piece of government mail that he later displayed to media outlets.

Richard Barnett became well known after a photo of him putting his feet on House Speaker Nancy Pelosi’s desk during U.S. Capitol Building insurrection surfaced. But a judge this week determined he is not dangerous enough to stay in jail as he awaits trial.
Instead, Barnett will be released and will be under a GPS monitor in Arkansas, CNN reported.
The chief judge of the D.C. District Court said Barnett needed to stay in jail shortly after the riot, the news station reported. However, defendants who were not accused of assault or planning an attack have mostly been released while the wait for trail, according to CNN.
Richard Barnett was ordered to remain in jail in January, but a judge ruled Tuesday that his case now was too similar to those of other defendants who were allowed to go home.

WASHINGTON (KAIT) - A Gravette man involved in the riot at the U.S. Capitol on Jan. 6 is out of jail and released to home detention.
A federal judge overturned a ruling keeping Richard Barnett, the man seen putting his feet up on House Speaker Nancy Pelosiâs desk and leaving a note.
District Judge Christopher Cooper ruled that while there are many concerning aspects of Barnettâs case and conduct, they are not enough to warrant detention while other rioters are being released.
