An Ontario Court judge has dismissed impaired charges against a Sudbury driver due to issues with the notes and testimony of two police officers and how they dealt with the accused.
The issues produced a successful challenge under the Charter of Rights and Freedoms and breath test results were excluded as evidence in the trial of Dawn Venne, held over several days in February and March of this year.

But Justice Heather-Ann Mendes did find the 36-year-old woman guilty Monday of two counts of failing to remain at the scene of an accident, fining her a total of $1,000 and issuing a six-month licence suspension.
