Seyfarth Synopsis: Earlier this month, New Mexico passed a statewide paid sick leave law, requiring all private employers with one or more employees to provide eligible employees with paid sick leave.  The law becomes effective July 1, 2022. On April 7, 2021, Governor Michelle Lujan Grisham signed into law the New Mexico Healthy Workplaces Act (the “Act”), House Bill 20,[1] which requires covered employers to provide eligible employees with paid sick leave and permits use of up to 64 hours of paid sick leave per year.  New Mexico is the sixteenth state to enact a statewide paid sick leave or paid time off (“PTO”) mandate, joining a number of neighboring or nearby states, including Arizona, California, Colorado and Nevada.[2] The new statewide law goes into effect on July 1, 2022.

Stowe died from COVID-19 last Monday. He had 23 years seniority at BNSF and was member of the Brotherhood of Locomotive Engineers (BLET) Division 98 in Lincoln, Nebraska. BNSF is the largest Class 1 railroad in North America and has 41,000 employees.

This law, effective July 1, 2022, will require all private employers to provide paid leave to employees that they can use for sick time, safe time, or other reasons for themselves or to care for or assist a broad list of family members. Covered Employer, Employees & Family Members The law will apply to all private employers and to all employees except employees subject to either Title II (air carriers) of the federal Railway Labor Act (RLA) or the federal Railroad Unemployment Insurance Act (RUIA). While the law does not apply to independent contractors, it expressly prohibits independent contractor misclassification and provides a sick-leave-related cause of action and damages for misclassifying workers.
