In a lengthy judgment delivered over Zoom, Ontario Superior Court Justice Michael Code said he didn’t believe a word of excuses or alternate theories proposed by Matharu and convicted him on four counts of criminal negligence causing death and one causing bodily harm.
“He knew that driving on insufficient sleep put public safety, and his own safety, at risk. He simply chose to take the risk, apparently giving his own financial self-interest priority,” Code said.
Matharu, 40, had been driving for 26 hours to deliver a 21,500 kilo-trailer of pork to the Maple Leaf Foods plant in Hannon, near Hamilton. He had been told to get there “ASAP.”

In 2015, after he attacked his mom and tried to kill his grandmother, Joel Vassell was found not criminally responsible due to his untreated schizophrenia. He was sent to Waypoint Centre for Mental Health in Penetanguishene and then to Whitby’s Ontario Shores.
After the Ontario Review Board released him into the community three years later, Vassell stopped taking his medication. The day after he unsuccessfully tried to get himself readmitted to Ontario Shores, he stabbed his mother, Yvonne Bachelor-Vassell, and set fire to her Etobicoke townhouse.
That’s taxpayer money snatched out of the pockets of you and me.
After years of delays and countless lawyers, Gill has had his licence yanked by the College of Physicians and Surgeons of Ontario for professional misconduct that put his patients at serious risk of harm “from his failure to recognize significant health conditions, his neglect or inadequate or inappropriate management and from complicating the work of consultants and others sharing in his patients’ care.”
According to the scathing decision, the Mississauga doctor’s delivery of poor medical care was “profound, pervasive and ongoing” and found in every patient chart examined.
