The governing law of the legal profession differs in Peninsular and East Malaysia. Should a party wish to commence a court action in East Malaysia, an advocate qualified under the Sabah or Sarawak Advocates Ordinance would have to be appointed. However, what about adjudication proceedings conducted under the Construction Industry Payment and Adjudication Act 2012, which allows parties to "be represented by any representative appointed by the party"? The high court recently shed light on this matter.

Kota Kinabalu: Sabah can lead to distinguish itself as an autonomous region by re-starting its own local election independent of the West Malaysian centric system that suspended the third vote in matters of governance in 1965, a mere two years after the formation of Malaysia.

Therefore, Sabah should initiate moves to restore local government elections for major councils, and consider reintroducing divisional level governments to manage Sabah’s vast areas effectively, and the financial means to carry out the elections should be affordably within revenue means of most towns.

Kota Kinabalu: The suspension of local government elections in Malaysia after Singapore left the Federation of Malaysia has affected good governance in Sabah.

According to Danesh Prakesh Chacko of Sunway University, Sabah’s local government powers are more than that provided for in West Malaysian states. He was presenting his Jan 20 paper, “Local Government Elections: Time to Reintroduce them” at the Bersih 2.0 webinar on the ‘Reintroduction of Local Government Elections in Malaysia.’
The additional powers from the colonial era ordinance provide for the role of Sabah’s local government were to “build, equip and maintain schools, educational institutions and maintain scholarship, as well as licencing bicycles and vehicles not required to be licenced.”
