Two men on Friday dropped a lawsuit they filed last June alleging Topeka s Frito-Lay plant maintained a hostile and racist environment, while a third plaintiff in that case continues to pursue that suit.
Attorneys representing Frito-Lay and plaintiffs Antonio Pead and Daniel Askew filed a joint stipulation of dismissal Friday in federal court. That stipulation doesn t affect the case continuing to be pursued by the case s third plaintiff, Melvin Smith.
The Capital-Journal tried unsuccessfully Monday to contact Frito-Lay and the attorneys representing Askew, Smith and Pead.
Kansas City, Mo.-based attorneys Tiffany B. Klosener and John J. Ziegelmeyer in June filed the suit against Frito-Lay Inc., on behalf of Pead, who was continuing to work at the Topeka plant at the time, and former Topeka plant employees Smith and Askew, who resigned their jobs in 2018 and 2019, respectively. It wasn t clear Monday if Pead still worked at the plant.

Smith Award as the Royal Bahamas Defence Force’s overall Marine of the Year for 2020.
