Bushiri Wants His Matter Referred to Constitutional Court for Interpretation: Matter Adjourned to Friday for Ruling

Lilongwe Chief Resident Magistrate Patrick Chirwa has adjourned the extradition case involving Prophet Bushiri and wife, Mary, to Friday, April 23, for a ruling if the matter should be referred to Constitutional Court for ruling. Bushiri lawyer, Wapona Kita, started the day by telling the court they are applying to have the entire extradition request thrown out for “lack of legal basis” and asks the court to refer the matter to the Chief Justice to certify it for the Constitutional Court hearing. The state, led by Steve Kayuni, contested this submission, stating that at the last appearance Magistrate Chirwa ruled that there should be no further applications relating to this matter.

Collins Magalasi s case adjourned to 3pm

Senior Resident Magistrate Shireen Chirwa has adjourned to this afternoon the case in which former executive director of the Malawi Energy Regulatory Authority-Mera Collins Magalasi is accused of abusing his office in 2018. Earlier, Magalasi’s lawyer Andy Kaonga requested the court for an adjournment to a later date because he had insufficient time to go through some documents, and since had a health challenge. However, the magistrate denied to grant the adjournment, upon which Kaonga told the court to recuse itself on the basis that it is biased toward the state. The case continues at three pm, when Magistrate Chirwa will make a ruling on that.

Oops!Muhara, Mchacha s Case Committed to High Court

The Lilongwe Senior Resident Magistrate Shyreen Chirwa has committed to the High Court a case which former minister of lands, Symon Vuwa Kaunda, former minister of irrigation and water development, Charles Mchacha, ministry of defense Principal Secretary, Bright Kumwembe and former Chief Secretary to government, Lloyd Muhara are answering. They were arrested in connections of a dubious sale of Plot Number LW 1366 (Kanjedza Forest) belonging to the Department of Forestry to Mchacha without following proper procedures. Last month, Principal Resident Magistrate Viva Nyimba quashed their corruption charges saying the State arrested the suspects illegally as there was no Anti Corruption Bureau (ACB) Director following Matemba’s contract expiry on December 1, 2020.
