Before looking at the Bandelle decision, s 6.20 of the EPA Act
provides a long-stop limitation period of 10 years for
any loss arising from defective building works, irrespective of
when defects become apparent. Essentially, s 6.20 prevents any
person from bringing civil proceedings for loss or damage arising
from defective work if the works were completed more than 10 years
prior.
The intent of this provision is stop parties bringing actions
for allegedly defective works well after those works were
completed.

A prominent environmental group has said it is “outraged” by a proposal to build overhead transmission infrastructure through the Kosciuszko National Park, with the National Parks Association of NSW saying the works would destroy a significant portion of the national park.
The NSW government is planning to amend the Plan of Management for Kosciuszko National Park, exempting the Snowy 2.0 development from a requirement that all electricity network infrastructure be built underground.
The management plan is intended to protect the Kosciuszko National Park, and placing electricity network infrastructure underground would minimise the impact of new transmission lines that are set to be constructed to serve the Snowy 2.0 expansion.

Subscriber only A Queensland developer is appealing a Land and Environment Court ruling in a further attempt to reduce contributions owed to Ballina Shire Council. Intrapac, the developer behind the Aureus estate in Skennars Head, took the council to the Land and Environment Court when it did not, within a certain period of time, approve an application to reduce developer contributions arising from the 229-lot subdivision. The development was approved by the Northern Regional Planning Panel, with conditions including $4,580,000 worth of contributions to be paid to the council. Intrapac was also required to build a new roundabout, embellish parks within the development and invest $15,000 in public art.
