Jan Gerber, News24 Public Protector Busisiwe Mkhwebane says she isn t asking the Constitutional Court to rescind its decision in the Bosasa matters as an attempted back door appeal , but to correct what she believes to be a totally erroneous judgment . On Friday, the Office of the Public Protector approached the Constitutional Court with an application for the rescission or reconsideration of its dismissal of her appeal against the High Court s decision to set aside the Bosasa investigation report. In her founding affidavit, Mkhwebane said she believed in this instance there were truly exceptional circumstances that warrant this court revisiting and rescinding its totally erroneous judgment .
