An Altoona man, who continued to fight drug charges filed against him in 2010 even though he had already completed his prison sentence, has now lost his appeal before the Pennsylvania Superior Court.
Shawn Edward Gibson, who appeared before Blair County Judge Daniel J. Milliron last year concerning his release on bail from the State Correctional Institution at Pine Grove, said he was continuing with his appeal before the Superior Court because, “I want to clear my name.”
He maintained that he shouldn’t have been arrested in the first place.
Milliron had already indicated that Gibson was entitled to be resentenced on his charges based on a 2013 U.S. Supreme Court ruling, known as the Alleyne case, that found Pennsylvania’s mandatory sentencing laws unconstitutional.

A panel of judges from the 3rd Circuit Court of Appeals in Philadelphia has rejected a request from a Clearfield man to address what he considers undue delay in hearing his appeal before the U.S. District Court in Johnstown.
The defendant, Luther L. Ware Jr., 70, is serving a prison term of 11 to 30 years at the State Correctional Institution at Houtzdale.
Ware was convicted in 2015 on two counts of possession with intent to deliver cocaine, delivery and related offenses of participating in a corrupt organization, dealing in the proceeds of unlawful activity and criminal use of a communication facility.

A former itinerant preacher who is serving a 66 year, eight month, minimum prison sentence for the rape of a Bedford County child has been granted a new hearing by the Pennsylvania Superior Court.
Walter Donald Bradshaw, 71, has been seeking a hearing for several years so he can challenge the effectiveness of his attorneys. Bradshaw claims the attorneys may not have told him about a possible plea agreement for a much lighter sentence.
A panel of Superior Court judges ruled 2-1 late last week that Bradshaw was entitled to present his argument before a Bedford County judge. The panel ordered a new post-conviction hearing.
