The case covers 80% of the state s students, including Native Americans and those who are low-income or disabled. Lawyers representing the students say educational opportunities would not have been as inadequate had the state complied with the court order and ensured access to technology for all students. In a motion filed Tuesday, they asked a court to compel the state to provide laptops and internet to students who still lack them.

Currently, none of the popular destinations for ice fishing are open as the ice is still considered unsafe for fishing. New Mexico State Parks are open for day use only, usually between the hours of 7 a.m. to 4 p.m. Only New Mexico residents may use the facilities. Masks must be worn and social distancing practiced. Many people are surprised that there is ice fishing in New Mexico and that temperatures can plummet to well-below zero in many locations.

The conflict involves how water is apportioned between New Mexico and Texas under an interstate compact first approved by Congress in the mid-twentieth century. Texas v. New Mexico centers around the Pecos River, which originates in north-central New Mexico near Santa Fe and flows into Texas, emptying into the Rio Grande. In 1948, the two states authored the Pecos River Compact with the goal of providing for the equitable apportionment of the use of the river’s water by both states and to “remove causes of present and future controversies.” Congress approved the contract the following year.

The decision issued Monday centers on evaporation and New Mexico s obligations to deliver a certain amount of water to Texas each year. The court found that the river master overseeing the compact between the two states correctly calculated that New Mexico should get credit for floodwater it stored in 2014 at the request of Texas. That state had argued that a significant amount of water had evaporated while it was in storage.
