As the civil trial began Sunday in federal court over the sale of Alabama’s Bellefonte Nuclear Plant, indications are that no verdict will be coming soon.
U.S. District Judge Liles Burke is presiding over the case and, as a bench trial, he will render the verdict. There is no jury.
Discussions Sunday between the judge and attorneys from Nuclear Development, which brought the suit against TVA for breach of contract when the federal utility opted not to complete the sale as planned in November 2018, discussed submitting briefs several weeks after testimony concludes.

Another day of reckoning for the long-beleaguered nuclear plant in northeast Alabama is at hand.
The lawsuit brought by the company seeking to purchase the unfinished plant, which collapsed hours before the deal’s closing date, will go to trial in U.S. District Court in Huntsville on Sunday.
Nuclear Development LLC, a company formed by Tennessee developer Franklin Haney for the purpose of purchasing Bellefonte Nuclear Plant near Scottsboro, filed a breach of contract lawsuit in 2018 against Tennessee Valley Authority – which owns the plant.
The case will be heard and decided by U.S. District Judge Liles Burke. There will be no jury.
The company ensnared in a years-long legal battle to buy an unfinished nuclear plant from the Tennessee Valley Authority showcased a new tactic Wednesday tying the fight over the Bellefonte Nuclear Plant to President Joe Biden s plans to curtail climate change.
Nuclear Development, a private company owned by real estate developer Franklin Haney and his family, sent out a news release this week that tied the company s long-held plans to buy Bellefonte to the new push to decarbonize the nation s electric grid.
“There is a major mismatch between the strategy TVA’s previous leadership adopted and the new federal decarbonization targets. The public-private Bellefonte partnership we originally put forward which is still on the table is a real opportunity for TVA’s current leadership to fix that.
