Federal judge cites U S Capitol breach in denial of Parler s initial motion for reinstatement on AWS

Federal judge cites U.S. Capitol breach in denial of Parler’s initial motion for reinstatement on AWS January 22, 2021 at 10:27 pm A federal judge in Seattle has denied an initial attempt by Parler to require Amazon Web Services to restore cloud services to the controversial social network, referencing the Jan. 6 breach of the U.S. Capitol as one of the factors in the decision. “The Court explicitly rejects any suggestion that the balance of equities or the public interest favors obligating AWS to host the kind of abusive, violent content at issue in this case, particularly in light of the recent riots at the U.S. Capitol,” wrote U.S. District Judge Barbara Jacobs Rothstein in the ruling Thursday afternoon. “That event was a tragic reminder that inflammatory rhetoric can more swiftly and easily than many of us would have hoped turn a lawful protest into a violent insurrection.”

Judge Rejects Parler s Request for Order Forcing Amazon to Keep Hosting Service

Judge Rejects Parler’s Request for Order Forcing Amazon to Keep Hosting Service A federal judge on Jan. 21 denied a request from Parler that sought to have the court order Amazon Web Services (AWS) to continue hosting the service. U.S. District Judge Barbara Jacobs Rothstein, a Carter appointee, said that Parler failed to meet the standard for the issuance of a preliminary injunction. “To be clear, the Court is not dismissing Parler’s substantive underlying claims at this time. Parler has fallen far short, however, of demonstrating, as it must, that it has raised serious questions going to the merits of its claims, or that the balance of hardships tips sharply in its favor. It has also failed to demonstrate that it is likely to prevail on the merits of any of its three claims; that the balance of equities tips in its favor, let alone strongly so; or that the public interests lie in granting the injunction,” she wrote in the 14-page order.
