Prairie State Generating s suit against panel provider Centria settles in federal court | Madison

Schneidewind BENTON – Prairie State Generating and a Kentucky business settled a claim that exterior wall panels at Prairie State’s power plant in Washington County failed.  The power company and panel provider Centria announced an agreement to Senior U.S. District Judge Phil Gilbert on March 25.  They followed through with a joint stipulation on March 29.  Files show the plant cost $28 million including $4.6 million for the panels.  Prairie State retained David Schneidewind of Boyle Brasher in Belleville, and he sued Centria in Washington County circuit court in 2018.  The suit claimed general contractor A.C. Dellovade contracted with Centria to design and manufacture panels, and Centria provided a warranty to cover the finishing coat for 20 years. 

Gilbert says Wendler must pay defendants fees and costs for litigating in wrong court | Madison

Carpenter BENTON – Senior U.S. District Judge Phil Gilbert ordered Edwardsville lawyer Brian Wendler to pay fees and costs for defendants that litigated in the wrong court for seven months due to an error he committed.  Gilbert passed the bill to Wendler on March 26, in the process of remanding the case to St. Clair County where it began.  Trailer maker Cottrell Inc. and its contractor Cambarloc Engineering had removed it to district court on the basis of information Wendler provided.  Wendler represents Jack Cooper Transport car hauler Jimmy D. Hill, who claims he injured his left hand and arm while using a defective ratchet. 

Struggle over ownership of Wood River adult boutique litigated in three courts

Smyk BENTON – In courts of three states, father John Kenneth Coil and son John Altaire Coil both claim full ownership of Dr. John’s adult boutique in Wood River.  Senior U.S. District Judge Phil Gilbert stayed their proceedings in his court on March 1, until another court determines ownership.  Gilbert found his abstention was appropriate to conserve scarce judicial resources and provide a comprehensive dispensation of litigation.  Father John and son John portray each other as crooks on a grand scale.  In January 2019, John Altaire sued John Kenneth in Dallas County, Texas.  He sought to block his father’s sale of property on Anaheim Drive in Dallas, alleging fraud, gross negligence, and breach of fiduciary duty, and seeking direct recovery under Texas business organization code. 

Gilbert appoints attorney for prisoner seeking $75 million from DuPont over C-8 discharge

Sowle BENTON – Senior U.S. District Judge Phil Gilbert appointed attorney Britt Sowle of Edwardsville to find out whether prisoner Robert Christopher Adams might have a viable injury claim against DuPont.  Sowle, who entered his appearance on Jan. 14, must first achieve service of a suit Adams wanted to serve on DuPont but couldn’t.  Sowle must also obtain an information sheet Adams requested.  “All this should be accomplished by February 19, 2021,” Gilbert wrote.  Adams signed a complaint at Western Illinois prison in Mount Sterling in June and mailed it to district court.  He sought $75 million in compensatory and punitive damages and all medical expenses for colitis.
